Small Community Airlines OST-2005-21822 - Commuter Air Carrier - Dallas Love Field, TX-Lake Charles Regional Airport, LA June 10, 2005 Application to Conduct Scheduled Passenger Operations as a Commuter Air Carrier - Bookmarked SCA intends to operate two BAE Jetstream 3100 19 passenger turboprop airliners in Texas and Louisiana serving Lake Charles and Dallas Love Field with scheduled flights twice a day, 7 days per week. Lake Charles has agreed to a private/public partnership as outlined in the Memorandum of Agreement (Exhibit P) for a period of 1 year from commencement of operations. SCA intends to operate charter flights when the opportunity presents itself. Maintenance will be performed by the airline at SCA headquarters at DAL. August 8, 2005 Re: Confidential Treatment Request We have decided to grant confidential treatment to some, but not all, of the information for which such treatment is sought. Specifically, we have decided to grant confidential treatment to information containing forecast revenues and related statistics, personal financial documents, and contractual information that would not otherwise be available to the public. October 28, 2005 On September 28, 2005, SCA filed some of the information in the public record that was denied confidential treatment by our August 8 decision. As a result of this partial filing, the record of this case is incomplete. To date, we also note that SCA has neither filed a petition for reconsideration nor has it indicated in the record that it intends to seek judicial review of our findings in these matters. November 3, 2005 As per our conversation with Damon Walker, I sent copies of the items that went missing from our original filing on over to him via email. We were under the impression based on his first letter that we had included everything requested, but the information we had was somewhat unclear and resulted in the confusion we are very quickly working to clear up at this time. Now that we have received a new, clearer list of what is required for our filing, we are reporting back to you herein that we took action today to get all missing materials to the appropriate people. We eagerly request that if there are still any items missing after this, our second attempt at the provision of required materials, that you please make it known to us so we can immediately follow up both with soft copies via email and hard copies as well. This review has revealed the need for additional and/or clarifying information before we can complete processing of SCA’s application. January 31, 2006 Re: Information Request - Bookmarked Small Community Airlines is a commuter airline committed to providing quick, reliable and cost effective transportation between communities where little or no air service currently exists. Small Community Airlines stands poised to help smaller communities enhance their airline service outlined by the public/private partnership concept initiated by the DOT. Small Community Airlines is only interested in P/PP with revenue guarantees and other incentives. We will provide air service to the small communities at a time when three of the six major air carriers are in bankruptcy and exiting the small markets. Small communities at risk of more air service cuts despite Congress's promise to maintain service to the small communities. April 3, 2007 DOT Request for Additional Information On February 9, 2006, and January 11, 2007, SCA filed motions for confidential treatment under 14 CFR 302.12 for certain material filed in support of its application for certificate authority. By letter dated February 7, 2007, we ruled on these motions and granted the request, in part At that time, we informed SCA that the information for which confidential treatment was denied must be filed in Docket OST-2005-21822 within five business days, unless a petition for reconsideration is filed with the Department or a written statement is filed indicating that SCA in good faith intends to seek judicial review of the Department's decision. On February 27, 2007, SCA filed some of the information in the public record that was denied confidential treatment by our February 7 decision. As a result of this partial filing, the record of this case is incomplete. While the Department does closely work with applicants through the application process, it is not our policy to keep incomplete applications open indefinitely. Further, since this is a public proceeding, the Department expects the record of this case to fully conform to the filing requirements enumerated in 14 CFR 204.3. Therefore, within 14 days of the date of this letter, SCA should submit in Docket OST-2005-21822 the information for which the Department denied confidential treatment as identified in our February 7, 2007, letter. February 20, 2009 Re: Final Request for Additional Information By letter July 2, 2008, we requested additional andlor clarifying information from Small Community Airlines, Inc. in order to complete our evaluation of the applicant's fitness to conduct scheduled passenger operations as a commuter air carrier. To date we have not received a response to our request. Moreover, given the time that has elapsed since SCA filed its application and supporting material, it appears that much of this information may be out of date. Therefore, in order for us to complete our review of the applicant's fitness, we ask that you respond fully to the attached information request within 30 days of the date of this letter. As is the Department's practice, further processing of SCA's application will be deferred pending receipt of this material. In addition, please remember that SCA should promptly provide the Department with any information regarding changes it may undergo in areas affecting its fitness (i.e., management, operating plans or financial condition, compliance disposition, or ownership) while its application is under review by the Department. December 18, 2009 Re: DOT Intention of Dismissal of Application On June 23, the Department requested further information from Small Community Airlines, Inc. to supplement its application. The company's response was due to the Department on July 7, 2009. On July 14, we reminded SCA that we had yet to receive the information we requested. At this time the SCA informed us that it was in the process of changing its Director of Operations and that it would provide the relative fitness information once a new Director of Operations was determined. To date, however, we have not received any additional information or response from SCA. It is not the Department's policy to keep incomplete applications open indefinitely. Therefore, unless SCA provides a complete response to our June 23 Information Request (copy enclosed) within 14 days of the date of this letter, we intend to dismiss its application without further notice. January 13, 2010 Per your request, we have decided to grant SCA an additional 14 days (i.e. until January 27, 2010), to file the fitness information requested by our June 23 letter. In addition, because much of the evidentiary material submitted in support of SCA's fitness has now become outdated, we will need additional information demonstrating SCA's fitness before we are able to make a positive fitness finding in this case.
