OST-2005-21805 - Foreign Air Carrier Permit - Austria-US Charter Passenger July 6, 2005 Application for a Foreign Air Carrier Permit - Bookmarked Tyrolean Jet Services, an executive air transport company organized under the laws of Austria, operates five executive-configuration business jets, including one Dornier 328JET, one Dornier Executive 328JET, one Cessna Citation VII Business Jet, and two Bombardier Global Express aircraft. TJS uses these aircraft to provide executive charter service between points in Europe and various destinations worldwide. In order to hold out and conduct these limited on-demand executive charter air services to and from points in the United States, TJS hereby applies for a foreign air carrier permit. Order 2005-11-11 Issued and Served November 15, 2005 Order Granting Exemption and to Show Cause | Word We grant the request of Tyrolean Jet Service Nfg. GmbH & Co. KG for an exemption under 49 U.S.C. §40109 to permit it to engage in charter foreign air transportation of persons, property and mail (1) between any point or points in Austria and any point or points in the United States; (2) between any point or points in the United States and any point or points in a third country or countries, provided that such service constitutes part of a continuous operation, with or without a change of aircraft, that includes air service to Austria for the purpose of carrying local traffic between Austria and the United States; and (3) between third countries and the United States in accordance with 14 CFR Part 212. In the conduct of these operations, Tyrolean Jet Service Nfg. GmbH & Co. KG may only use aircraft capable of carrying no more than 60 passengers and having a maximum payload capacity of no more than 18,000 pounds. We grant the request of Tyrolean Jet Service Nfg. GmbH & Co. KG for confidential treatment of its financial submissions, consistent with the provisions of 14 CFR §302.12. Our action granting the exemption authority described in ordering paragraphs 1-4 is effective immediately, for a period of two years from the issue date of this order, or until the attached permit becomes effective, whichever is earlier. With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Order 2006-1-9 Issued January 7, 2006 | Served January 13, 2006 By Order 2005-11-11, issued November 15, 2005, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to that Order and subject to the conditions attached to that permit. We gave interested persons 21 days to file objections to the Order. We said that if no objections are filed, all further procedural steps shall be deemed waived, and the Department will enter an order (subject to Presidential review under 49 USC §41307) which will make final the findings and conclusions of that Order. June 6, 2007 Application for an Exemption and Amended Foreign Air Carrier Permit Tyrolean Jet Services hereby applies under 49 U.S.C. 41301,41302 and 40109, Subparts B and C of the Department's Rules of Practice in Proceedings, Part 211 of the Department's Economic Regulations, and the Department's August 23, 2005 Notice in Docket OST-2005-22228 for an exemption and an amended foreign air carrier permit authorizing Tyrolean Jet Services to conduct the following services using small aircraft, in addition to the charter services authorized under its existing foreign air carrier permit, as of March 30, 2008:
Tyrolean Jet Services requests that the Department grant this application prior to March 30,2008 by proceeding directly to a final order issuing an amended foreign air carrier permit, pursuant to 14 C.F.R. 302.210(a)(2). Tyrolean Jet Services further requests that its amended foreign air carrier permit be granted for an indefinite term. In the event the Department does not anticipate the issuance of a final order granting an effective permit prior to March 30, 2008, Tyrolean Jet Services requests approval of an interim exemption under the show-cause procedures described in the Streamlined Licensing Procedures Notice. Order 2007-8-22 Issued and Served August 22, 2007 Order Granting Exemption and to Show Cause We grant the request of Tyroleain Jet Service for an exemption under 49 U.S.C. 40109 to permit it (1) effective on the issue date of this order, to accept payment, issue tickets, and enter into charter contracts; and (2) effective March 30, 2008, to commence flight operations, for the services: a) foreign charter air transportation of persons, property and mail from any point or points behind any Member State of the European Union, via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond; b) foreign charter air transportation of persons, property and mail between any point or points in the United States' and any point or points in any member of the European Common Aviation Area; and c) other charters pursuant to the prior approval requirements set forth in 14 CFR Part 212 of the Department's regulations. In the conduct of the operations; authorized, Tyrolean Jet Service may only use aircraft capable of carrying no more than 60 passengers and having a maximum payload capacity of no more than 18,000 pounds. With respect to the applicant’s request for an amended foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final, no later than twenty-one calendar days after the date of service of this order.
