Friendship Airways, Inc. d/b/a Yellow Air Taxi OST-2005-21533 - Authority to Conduct Scheduled Passenger Operations as a Commuter Air Carrier June 10, 2005 Application for Commuter Air Carrier Authority Motion to Withhold Confidential Information from Public Disclosure In 2003, with the financial backing mostly generated by himself, Mr. Behnam formed Friendship Airways, Inc. and began an on‑demand air taxi operation known as Yellow Air Taxi. Mr. Behnam did so by purchasing OPM, Inc. and its certificate authorities and then changed his company's procedures to conform to FAA regulations and to conform to his dream of a consumer‑friendly, safe and profitable airline. Today, Friendship Airways, Inc. has a fleet of four (4) Cessna 402C aircraft serving on‑demand charter markets from its home base in Ft. Lauderdale International Airport and markets in South Florida and the Northern and Central Bahamas. Should it receive the regulatory approval requested as described in this application, Friendship Airways, Inc., d/b/a Yellow Air Taxi intends to initiate scheduled service up to twice (2) daily to Marsh Harbour. This review has revealed the need for additional and/or clarifying information before we can complete processing of YAT's application. The attached Information Request lists the areas where further information and/or clarification is necessary. Counsel: Pierre Murphy, 202-776-3980, pmurphy@lopmurphy.com Order 2006-1-11 Issued and Served January 13, 2006 Order to Show Cause and Proposing Issuance of Commuter Air Carrier Authority | Word YAT, based at Ft. Lauderdale International Airport, was incorporated in 2003 under the laws of the state of Florida. Mr. Christopher Behnam, the company’s President and Chief Executive Officer, is the sole-owner of YAT. He is a U.S. citizen. Since its inception in 2003, YAT has been authorized to provide air taxi services under Part 135 of the Federal Aviation Regulations and Part 298 of our regulations. The company currently operates a fleet of four Cessna 402 aircraft, configured for nine passenger seats, primarily between and among destinations on the Southeastern U.S. Coast and the Caribbean. If granted commuter authorization, YAT will provide one roundtrip flight daily between Fort Lauderdale, Florida and Marsh Harbor, Bahamas, from July to October, and twice daily roundtrip service in that market between the months of November and June. YAT intends to provide the proposed services using its current fleet of Cessna 402 aircraft. In addition to its proposed commuter operations, the applicant states that it will continue to perform on-demand operations. By: Michael Reynolds Order 2006-1-22 Issued and Served January 30, 2006 By Order 2006-1-11, issued January 13, 2006, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions that Friendship Airways, Inc. d/b/a Yellow Air Taxi is fit, willing, and able to provide scheduled passenger service as a commuter air carrier using small aircraft pursuant to Part 135 of the Federal Aviation Regulations. Interested persons were given 14 calendar days to file objections to the order. No objections to the show-cause order were received. We issue a Commuter Air Carrier Authorization to Friendship Airways, Inc. d/b/a Yellow Air Taxi, subject to the Terms, Conditions, and Limitations attached. Counsel: Pierre Murphy, 202-776-3980, pmurphy@lopmurphy.com Order 2006-5-5 Issued and Served May 8, 2006 Order Confirming Oral Action and Issuing Effective Commuter Authorization By Order 2006-1-11, served January 13, 2006, the Department found that YAT, was fit to conduct scheduled passenger service as a commuter air carrier. Under the terms of Order 2006-1-11, the authority would become effective on the sixth (business day) after we had received (1) a copy of the carrier's Air Carrier Certificate and Operation Specifications from the Federal Aviation Administration authorizing it to engage in scheduled passenger service, (2) evidence of liability insurance coverage that meets the requirements of section 205.5(b) for all its aircraft, (3) a statement of any changes it had undergone in areas affecting its fitness subsequent to the issuance date of the Show Cause Order in this case (Order 2006-1-11), and (4) updated financial information and evidence that the carrier still had available to it funds sufficient to meet the Department's financial fitness criteria. On March 17, 2006, we received the required statement that the carrier had undergone no changes in ownership, key personnel, compliance history, operating plans or financial posture since the issuance of the Show Cause Order. The air carrier also provided a revised pre-operating list of expenses and third-party verification of its available funds, evidencing that YAT continues to meet the Department's financial fitness criteria. On April 11, 2006, we received a copy of the air carrier's certificate of insurance meeting the requirements of section 205.5(b) and on April 13, 2006, we received a copy of YAT's amended Operation Specifications reflecting FAA authority for scheduled passenger service as a commuter air carrier. Upon review of these documents, we concluded that YAT remained fit to conduct its proposed commuter operations. Therefore, on April 18, 2006, we orally advised YAT that we were making its commuter authority effective on that date. By this order, we confirm our oral action and reissue to YAT its commuter air carrier authorization to reflect its effective date. By: Todd Homan |
