Atlas Air, Inc. and Polar Air Cargo, Inc. OST-2005-21441 - Approval of a Transfer of Route Authority - Ecuador Frequencies June 6, 2005 Atlas and Polar request that the Department approve pursuant to 49 U.S.C. §41105, or in the alternative disclaim jurisdiction over, the transfer to Polar of. (1) the U.S. -Ecuador all-cargo exemption and four of the six frequencies awarded to Atlas by Order 2004-3-16; and (2) the designation Atlas holds to perform U.S.-Ecuador all-cargo service. As explained more fully below, the Ecuador route transfer and related regulatory actions are being undertaken as part of a broader corporate strategy to increase functional efficiencies by consolidating Atlas operations into Polar, with the surviving certificated air carrier, Polar Air Cargo, Inc., doing business under both the Atlas and Polar brands. To enable Polar to commence the lengthy licensing process in Ecuador, the Joint Applicants further request immediate pendente lite re-issuance of the Ecuador exemption and designation in the name of "Atlas Air, Inc. or Polar Air Cargo, Inc."
