Application for Exemption Authority

Pursuant to 49 U.S.C. § 40109, ASTAR Air Cargo, Inc. seeks an exemption to provide scheduled foreign air transportation of property and mail between Los Angeles, California and Mexico City, Mexico. ASTAR has filed a companion application seeking an amendment to its Certificate of Public Convenience and Necessity for Route 725 to provide scheduled foreign air transportation of property and mail between Los Angeles and Mexico City pursuant to 49 U.S.C. § 41102

Scheduled foreign air transportation of property and mail between the terminal point Los Angeles, California, and the terminal point Mexico City, Mexico.  Astar also requests route integration to combine this exemption authority with Astar’s existing certificate and exemption authorities.  Astar states that it is requesting this authority to allow Astar to combine this service with its Cincinnati-Mexico City service. In this regard, Astar also requests that the waiver (or non-imposition) of the dormancy provisions for intermittent or seasonal services stated in condition 12 of its certificate for Route 725 apply to the instant route.

Astar states that it intends to operate five round-trips flights weekly over a Cincinnati-Mexico City-Los Angeles-Mexico City-Cincinnati routing using DC-8-73 equipment as soon as possible.

Astar, successor to DHL Airways, is one of a total of five U.S. carriers designated to provide scheduled all-cargo services in the U.S.-Mexico market under the U.S.-Mexico aviation agreement.

Application for Renewal of Exemption and Expedited Treatment of Certificate Amendment Request

ASTAR Air Cargo, Inc. seeks renewal of its exemption authority and expedited treatment of its request for an amendment of its certificate authority to provide scheduled foreign air transportation of property and mail between points in the United States and Mexico. Specifically, ASTAR requests renewal of its exemption authority between:

  1. Wilmington, OH and Saltillo, Mexico City, Guadalajara and Monterrey;
    and between Austin, TX, Houston, TX, Cincinnati, OH and Saltillo
    (expiring on June 6, 2007, Docket OST-2005-20827);
  2. Los Angeles, CA and Mexico City (expiring on June 14, 2007, Docket OST-2005-21306); and
  3. A) El Paso, TX and Saltillo, and
    B) San Antonio, TX and Saltillo
    (expiring on September 12, 2007, Docket OST-2005-22042)

In addition, pursuant to the Notice issued in In the Matter of Streamlining Regulatory Procedures For Licensing U. S. and Foreign Air Carriers served by the Department on August 26, 2005 in Docket OST-2005-22228, ASTAR seeks expedited treatment of its requests to amend its Certificate of Public Convenience and Necessity (Route 725) to replace the corresponding exemptions (Dockets OST-2005-20828, OST-2005-21307, OST-2005-22621 respectively) and include all of ASTAR’s US-Mexico authority in one certificate. Specifically, ASTAR requests that the Department amend, by final order in accordance with 14 C.F.R. §302.210(a)(2), ASTAR’s Mexico route authority under the new streamlined procedures by adding the above-listed city pair routes without the issuance of an intermediate show-cause order.

ASTAR requests renevval of the exemptions for a period of two years or until the Department acts on ASTAR’s companion Applications for amendment to its Certificate of Public Convenience and Necessity (Route 725) (Dockets OST-2005-20828; OST-2005-21307; OST-2005-22621).

Docket OST-2005-20827 - Scheduled foreign air transportation of property and mail between (1 ) Wilmington, Ohio, and Saltillo, Mexico; (2) Wilmington, Ohio, and Mexico City, Mexico; (3) Wilmington, Ohio, and Guadalajara, Mexico; ( I ) Wilmington, Ohio, and Monterrey, Mexico; (5) Austin, Texas, and Saltillo, Mexico; (6) Houston, Texas, and Saltillo, Mexico; and (7) Cincinnati, Ohio, and Saltillo, Mexico, on a seasonal basis.

Docket OST-2005-21306 - Scheduled foreign air transportation of property and mail between Los Angeles, California, and Mexico City, Mexico.

Docket OST-2005-22042 - Scheduled foreign air transportation of property and mail between (1) El Paso, Texas, and Saltillo, Mexico; and (2) San Antonio, Texas, and Saltillo, Mexico.

Astar also requested that the Department take action, by final order, on its pending certificate applications in Dockets OST-2005-20828, OST-2005-21307, and OST-2005-22621, to amend its certificate authority for Route 725 to add the exemption authority renewed in this Notice of Action Taken. We will act on the carrier’s certificate applications subsequently.
