Trans Capital Air Ltd. OST-2005-20934 - Exemption - Canada-US Scheduled and Charter Passenger Service April 6, 2005 Trans Capital plans to initially provide charter-only foreign air transportation between points in Canada and points in the United States utilizing four leased Stage 3 DeHavilland Dash 7 aircraft configured to carry 48 passengers. In addition, Trans Capital plans to provide freedom passenger charter flights between points in the United States and points in Third Countries in the Caribbean region, operated pursuant to, and in compliance with, Part 212 of the Department's Economic Regulations. May 30, 2006 Application for Renewal of an Exemption Trans Capital hereby applies for renewal of its temporary exemption from 49 U.S.C 41301 authorizing Trans Capital to perform transborder non-scheduled charter flights carrying persons, property and mail between any point or points in Canada and any point or points in the United States pursuant to the February 1995 Bilateral Air Transport Services Agreement between Canada and the United States, as amended. The exemption authority at issue was initially granted to Trans Capital for a one-year period by Notice of Action Taken issued on June 13, 2005. Trans Capital requests that the foregoing exemption authority be renewed for a further period of one year, through June 13, 2007, or until 60 days after final action by the Department on a forthcoming application by Trans Capital for grant of a Foreign Air Carrier Permit pursuant to 49 U.S.C. 41302 authorizing the same broad-scope transborder operations, whichever occurs first. Trans Capital is a Canadian charter air carrier based in Toronto, Ontario. It performs on-demand passenger charter flights within Canada, utilizing a fleet of four leased Canadian-registered DeHavill and Dash 7 aircraft configured to carry 48 passengers. In addition, Trans Capital provides on-demand emergency medical evacuation flights carrying seriously-injured or gravely ill U.N. peacekeeping personnel between Port-au-Prince, Haiti and Miami, Florida (and between Haiti and Santo Domingo, D.R., which also has suitable hospital facilities), pursuant to a two-year contract with the United Nations. The Haiti-Miami on-demand charter flights for the U.N. are operated pursuant to Trans Capital’s exemption authority and a Statement of Authorization granting Trans Capital limited special-purpose 5th freedom passenger charter authority. The exemption authority at issue was most recently renewed for a one-year period by Notice of Action Taken issued on June 22, 2006. Trans Capital requests that the foregoing exemption authority be renewed for a further period of one year, through June 22, 2008, or until 60 days after final action by the Department on a forthcoming application by Trans Capital for grant of a Foreign Air Carrier Permit pursuant to 49 U.S.C. 41302 authorizing the same broad-scope transborder operations, whichever occurs first.
