Application for an Exemption

FedEx Express has served Kazakhstan on an interline basis for many years. The Company has an agent in Kazakhstan which handles pick-up, delivery, and customs clearance. At present, FedEx offers service to points throughout Kazakhstan, utilizing interline air service and in-country logistics provided through its agent. On October 29, 2003, FedEx Express began using Almaty as a refueling stop on January 31, 2005 its Hong Kong - Paris flights, because refueling enabled FedEx Express to increase the westbound Asia-Europe cargo capacity of each flight by 55,000 pounds with little circuity. Almaty boasts a 4,400-meter long runway, modem fuel supply facilities, and highly professional technical support and services. Boosted by strong cargo growth, FedEx Express believes that the time is now right for it to inaugurate scheduled third, fourth, and fifth freedom U.S.-Kazakhstan services, linking North America, Europe, and Asia.

FedEx Express intends to serve Almaty on its Asia-Europe services, and seeks flexibility to link Almaty with the various Asian and European cities it serves as traffic demands. FedEx Express will operate through Almaty using MD-11 equipment having a gross payload of 196,000 pounds. The service will connect with the FedEx Express international network at points along the route.

Re: Polling Letter

This is to confirm that FedEx Express contacted all air carriers on the service list for this docket, and that all have stated that they do not intend to object to the application.

As stated in our initial application filed January 31, 2005, FedEx Express seeks expedited consideration of this application, since it intends to start the proposed service on February 27, 2005. Given the non-controversial nature of this application, FedEx Express asks that the Department complete its review on an expedited basis, and approve the application as soon as possible, but no later than February 21, 2005. A copy of this letter has been served on all parties, in the manner indicated on the attached service list.

Application for Renewal of an Exemption

FedEx Express seeks renewal of its exemption to operate between the United States and Kazakhstan and beyond, via intermediate points. FedEx Express requests that this authority be renewed for at least two years.

FedEx Express currently provides U.S.-Almaty service using NM-11 equipment having a gross payload of 196,000 pounds. Since receiving its initial grant of operating authority from the Department, FedEx Express has created a regional hub in Kazakhstan. This hub enables it to efficiently transship cargo between points in Asia and points in Europe. The hub enables FedEx Express to offer customers across the Asia-Pacific region tangible benefits, including later cut off times, greater capacity, and extensive connectivity to a wide range of European destinations. Most recently, on July 3, 2006, FedEx Express began offering international Priority Freight service from the U.S. to Kazakhstan.

The Department's grant of exemption authority in 2005 allowed FedEx Express to be the first U.S. air carrier to operate a regularly scheduled flight into Kazakhstan with full traffic rights. FedEx Express has used its U.S.-Kazakhstan exemption authority to provide the highest quality of efficient, convenient, and reliable air express/cargo service between the United States and Kazakhstan. Almaty's airport infrastructure and strategic locale as a refueling stop for FedEx Express' Hong Kong Paris, Shanghai Frankfurt, and Frankfurt - Tokyo flights have also enabled FedEx Express to compete more effectively in the expanding trade relationship between Asia and Europe.
