Application for an Exemption

Chautauqua is a well-established, highly successful regional airline providing extensive scheduled interstate and foreign air transportation (including U.S.-Canada service) using EMB-135, -140 and -145 regional jets equipped with 37 to 50 seats. Chautauqua operates its regional jet service on a codeshare basis with major U.S. carriers. Chautauqua was recently awarded a certificate of public convenience and necessity authorizing it to engage in interstate scheduled air transportation using "large" aircraft, thereby enabling it to commence service using ERJ-170 aircraft configured with 70 passenger seats. Order 2004-11-1.

Chautauqua seeks the flexibility to use its ERJ-170 aircraft on existing and new U.S.-Canada routes, but requires an exemption to do so. Chautauqua recently underwent a DOT fitness evaluation in connection with its ERJ-170 operations in Docket OST-2004-18638.

Notice of Action Taken

Scheduled foreign air transportation of persons, property, and mail between any point or points in the United States and any point or points in Canada. Chautauqua Airlines also requests authority to integrate this authority with its existing certificate and exemption authority.

Chuatauqua is a well‑established carrier providing extensive service with aircraft with less than 60 seats (small aircraft). It was recently awarded Department authority to engage in interstate scheduled transportation with aircraft with 70 seats. Chautauqua operates its regional service on a code‑share basis with major U.S. carriers and it now proposes to use aircraft with 70 passenger seats, in addition to its commuter service with small aircraft.

Application for Renewal of an Exemption

Chautauqua Airlines, Inc. hereby applies under 49 U.S.C. § 40109 for renewal of an exemption authorizing Chautauqua to continue to provide scheduled foreign air transportation of persons, property, and mail between any point or points in the United States and any point or points in Canada, and to continue to integrate this authority with its existing certificate and exemption authority. This authority was granted by Notice of Action Taken dated April 1, 2005 (Docket OST-2005-20255) for a two-year period expiring April 1, 2007. Chautauqua requests renewal for a period of at least two additional years, or until 90 days after the Department's final determination on an application of Chautauqua for U.S.-Canada certificate authority, whichever occurs earlier.

Chautauqua originally sought and obtained U.S.-Canada exemption authority to enable it to commence service using 70-seat ERJ-170 airplanes on new and existing U.S.-Canada routes. Although Chautauqua currently provides service using only small aircraft, meaning its flights in foreign air transportation would be authorized under the blanket exemption of 14 C.F.R. § 206.5, Chautauqua wishes to renew its U.S.-Canada exemption authority to provide it with the flexibility to serve U.S-Canada routes without delay in the event that it were to resume service using larger regional jets in the future.

ERJ-170 service has been allocated to Chautauqua's sister airlines, Shuttle America Corporation and Republic Airline Inc. The three carriers are wholly-owned subsidiaries of Republic Airways Holdings, Inc.
