Application for an Exemption

Applies for an exemption from 49 U.S.C. § 41101 which will allow Continental to provide scheduled foreign air transportation of persons, property and mail pursuant to codeshare agreements with Air France, COPA and KLM between points in the United States and foreign points, subject only to standard codeshare notification requirements. Continental also asks the Department for authority to combine this authority with Continental's other certificate and exemption authority. Continental asks that this authority be awarded immediately so Continental and its codeshare partners will be free of requirements that no longer apply to competing codeshare partnerships.

Consolidated Answer of United Air Lines

In Docket OST-04-19148, United has requested an amendment to its current code-share-related exemption authority that would enable it to introduce new services with multiple blanket code-share partners to and from points in third countries for which United does not already hold certificate or exemption authority. This would allow United to expand its service offerings to the public without the burden of having to apply for a separate exemption on each occasion when it wants to code-share with these blanket code-share partners, consistent with applicable air service agreements, in situations where it lacks underlying route authority.

United agrees with Continental and Delta that the Department should consistently apply its code-share policy to all blanket code-share partnerships. As United has pointed out in Docket OST-2004-19148, the Department has recognized that due process requires it to extend "'similar treatment to similarly situated applicants" (Application of United, at 6, quoting Order 96-7-21, at 14) and accordingly United has no objection to the Department contemporaneously granting other pending applications from "similarly situated" U.S. carriers seeking similarly broad code-share-related exemption authority so long as the Department also approves United's pending application for similar authority.

Application for Renewal of an Exemption

Renewing the requested blanket exemption for Continental will serve the public interest since it will give Continental broad flexibility to continue providing services that will enhance international competition, increase the service options available for passengers and shippers between the U.S. and foreign points, eliminate the burden on carrier and Department staffs of requiring specific certificate or exemption authority for each codeshare point added, and allow Continental to benefit fully from the rights available to U.S. airlines under the relevant bilateral air transport agreements.

Continental and Air France hold authority to place Continental's CO code on flights operated by Brit Air, City Jet and Regional (see Department Action of November 12, 2004, in Docket OST-2004-19115), and Continental asks that its renewed exemption be broad enough to permit codeshare service on those carriers' flights.

Continental also offers codeshare service on flights operated by KLM regional codeshare partner KLM CityHopper (See Notices of Action Taken, Docket OST-2001-10880, November 7, 2003 and Docket OST-2002-11945, April 17, 2002) and asks that its exemption continue to be broad enough to cover codeshare service on flights operated by KLM CityHopper as well as by KLM.

Withdrawal of Renewal Application and Will Not Seek Codesharing Renewal

Air Exel is no longer operating, and the services it provided previously are now being provided by KLM Cityhopper. Consequently, the parties withdraw the March 18, 2004, application for renewal of Air Exel's exemption authority permitting it to codeshare with Continental and urge the Department to dismiss it.

For the same reason, Continental has not sought renewal of its exemption authority for codesharing with Air Exel in Docket OST-2005-20122.

Notice of Action Taken

Renewal of scheduled foreign air transportation of persons, property, and mail between points in the United States and points worldwide on a third-country code-share basis pursuant to blanket code-sharing statements of authorization previously approved by the Department.

The authorized foreign carriers are: Societe Air France, and the regional carriers Brit Air, City Jet Limited, and Regional; Compania Panamena de Aviçicion, S.A.; and Koninklijke Luchtvaart Maatschappij, and its regional carrier KLM CityHopper. We note here that originally the authority granted to Continental in the present docket included authority to provide code-share services with KLM's regional code-share partner, Air Exel (see Notice of Action Taken dated March 1, 2005). However, by letter dated March 5, 2007, Continental advises the Department that Air Exel is no longer operating and, thus, Continental does not seek renewal of its exemption authority for code-share services with Air Exel.

Applications for Statements of Authorization

Continental, Continental Micronesia, Colgan and Asiana apply pursuant to Part 212 of the Department's regulations for a statement of authorization to provide reciprocal Continental/Asiana codeshare services in foreign air transportation pursuant to the Air Transport Agreement between the United States and the Republic of Korea. Continental also applies for amendment of its blanket exemption from 49 USC § 41101 authorizing Continental to provide codeshare services at points served by Asiana which are neither in open-skies countries nor listed in Continental's certificate or exemption authority upon 30 days' notification to the Department, just as Continental has been allowed to do with other codeshare partners.

Continental and Asiana request that the codeshare statements of authorization be granted for an indefinite period, and Continental requests that its exemption authority be granted through March 5, 2011, to coincide with the expiration date of its existing blanket codeshare exemption authority.

Continental and Asiana plan to institute codesharing service on or about December 1, 2009, at open skies points and on the non-open skies routes listed in Appendix A. Continental and Asiana will notify the Department no later than 30 days before commencing any additional codeshare services to other non-open skies points not specified in their certificate, permit or exemption authority, and they accept the Department's standard conditions on limitedentry third-country codeshare services.

Continental requires supplemental exemption authority to implement the proposed codeshare agreement and maximize its flexibility to provide global, codeshare service by placing its code on SAS flights serving points for which Continental does not otherwise hold authority. Thus, Continental requests exemption authority to provide codeshare service at points served by SAS which are neither in open skies countries nor listed in Continental's certificate or exemption authority upon 30 days' notification to the Department, as Continental has been allowed to do with other carriers.

Applications for Reciprocal Codesharing

Continental and Brussels Airlines seek statements of authorization permitting Continental to display the SN* code on Continental flights and Brussels Airlines to display the CO* code on Brussels Airlines flights in conjunction with foreign air transportation of persons, property and mail: (i) between any point or points in the United States and any point or points in the European Union (on a nonstop basis and on routings via intermediate open-skies points); (ii) between any point or points in the US and any other point or points in the European Common Aviation Area where an open-skies agreement is being applied; (iii) between US points; (iv) between EU points; (v) beyond the EU to any point or points; and (vi) beyond the US to any point or points.5 In addition to codesharing between open-skies points, Continental and Brussels Airlines will commence code sharing at the non-open-skies points identified in Appendix A on or about June 1, 2010.

Continental holds blanket authority to serve open-skies countries pursuant to its Certificate for Route 836, issued by Order 2007-4-19, and blanket route integration authority issued by Order 2006-1-1. Brussels Airlines holds open-skies permit authority pursuant to Order 2010-3-11.

Blue1, Wideroe and Golden Air request blanket statements of authorization to implement their proposed codeshare-only services with Continental. As noted, Blue1, Wideroe and Golden Air do not plan to conduct any operations to or from the United States. Rather, the European Carriers seek only the authority necessary to display Continental's CO* designator code on their intra-European city-pair segments. Specifically, the European Carriers seek statements of authorization permitting them to display the CO* designator code of Continental on flights operated (i) between European Union points; (ii) between points in Norway; (iii) between points in the EU and points in Norway; (iv) between points in the EU and points in Norway and points in the European Common Aviation Area where an open skies agreement is being applied; (v) between the EU or Norway, and any open skies point or points; and (vi) beyond the EU or Norway to any point or points.

In addition, the European Carriers request underlying parallel exemption authority authorizing them to engage in scheduled foreign air transportation of persons, property and mail in support of their codeshare operations with Continental.

Similar blanket codeshare and exemption authority has been granted to numerous codeshare partnerships involving US and foreign airlines, including between Continental and SAS.
