Application for an Exemption

Applies for an exemption from 49 U.S.C. § 41101 which will allow Continental to provide scheduled foreign air transportation of persons, property and mail pursuant to codeshare agreements with Air France, COPA and KLM between points in the United States and foreign points, subject only to standard codeshare notification requirements. Continental also asks the Department for authority to combine this authority with Continental's other certificate and exemption authority. Continental asks that this authority be awarded immediately so Continental and its codeshare partners will be free of requirements that no longer apply to competing codeshare partnerships.

Consolidated Answer of United Air Lines

In Docket OST-04-19148, United has requested an amendment to its current code-share-related exemption authority that would enable it to introduce new services with multiple blanket code-share partners to and from points in third countries for which United does not already hold certificate or exemption authority. This would allow United to expand its service offerings to the public without the burden of having to apply for a separate exemption on each occasion when it wants to code-share with these blanket code-share partners, consistent with applicable air service agreements, in situations where it lacks underlying route authority.

United agrees with Continental and Delta that the Department should consistently apply its code-share policy to all blanket code-share partnerships. As United has pointed out in Docket OST-2004-19148, the Department has recognized that due process requires it to extend "'similar treatment to similarly situated applicants" (Application of United, at 6, quoting Order 96-7-21, at 14) and accordingly United has no objection to the Department contemporaneously granting other pending applications from "similarly situated" U.S. carriers seeking similarly broad code-share-related exemption authority so long as the Department also approves United's pending application for similar authority.

Application for Renewal of an Exemption

Renewing the requested blanket exemption for Continental will serve the public interest since it will give Continental broad flexibility to continue providing services that will enhance international competition, increase the service options available for passengers and shippers between the U.S. and foreign points, eliminate the burden on carrier and Department staffs of requiring specific certificate or exemption authority for each codeshare point added, and allow Continental to benefit fully from the rights available to U.S. airlines under the relevant bilateral air transport agreements.

Continental and Air France hold authority to place Continental's CO code on flights operated by Brit Air, City Jet and Regional (see Department Action of November 12, 2004, in Docket OST-2004-19115), and Continental asks that its renewed exemption be broad enough to permit codeshare service on those carriers' flights.

Continental also offers codeshare service on flights operated by KLM regional codeshare partner KLM CityHopper (See Notices of Action Taken, Docket OST-2001-10880, November 7, 2003 and Docket OST-2002-11945, April 17, 2002) and asks that its exemption continue to be broad enough to cover codeshare service on flights operated by KLM CityHopper as well as by KLM.

Withdrawal of Renewal Application and Will Not Seek Codesharing Renewal

Air Exel is no longer operating, and the services it provided previously are now being provided by KLM Cityhopper. Consequently, the parties withdraw the March 18, 2004, application for renewal of Air Exel's exemption authority permitting it to codeshare with Continental and urge the Department to dismiss it.

For the same reason, Continental has not sought renewal of its exemption authority for codesharing with Air Exel in Docket OST-2005-20122.

Notice of Action Taken

Renewal of scheduled foreign air transportation of persons, property, and mail between points in the United States and points worldwide on a third-country code-share basis pursuant to blanket code-sharing statements of authorization previously approved by the Department.

The authorized foreign carriers are: Societe Air France, and the regional carriers Brit Air, City Jet Limited, and Regional; Compania Panamena de Aviçicion, S.A.; and Koninklijke Luchtvaart Maatschappij, and its regional carrier KLM CityHopper. We note here that originally the authority granted to Continental in the present docket included authority to provide code-share services with KLM's regional code-share partner, Air Exel (see Notice of Action Taken dated March 1, 2005). However, by letter dated March 5, 2007, Continental advises the Department that Air Exel is no longer operating and, thus, Continental does not seek renewal of its exemption authority for code-share services with Air Exel.

Continental will need to have conducted code-share safety audits of its foreign partners prior to receipt of authority for such code-share services.

Panama City-Aruba (CO* on COPA)
-Santa Cruz, Bolivia (CO* on COPA)
-Port of Spain, Trinidad and Tobago (CO* on COPA)

COPA is already operating Panama City-Port of Spain service, and it will institute Panama City-Santa Cruz and Panama City-Aruba service in December.

Continental holds authority to place its designator code on flights operated by COPA in foreign air transportation "between points in the United States and points worldwide." (See Statement of Authorization No. 98-65, July 9, 1998 and Notice of Action Taken, Docket OST-2005-20122, March 1, 2005) COPA holds authority to offer the proposed service. (See Order 1998-3-16 and renewal application pending in Docket OST-1997-2675).
