Application for an Exemption

Hereby applies for an exemption from 49 U.S.C. §41301 in order to engage in scheduled foreign air transportation of persons, property, and mail between Abu Dhabi, Bahrain, Oman, and Qatar, on the one hand, via intermediate points, and a point or points in the United States, on the other, pursuant to a codeshare agreement with any U.S. or foreign airline that holds an appropriate Statement of Authorization to display the Gulf Air code on its flights. Gulf Air initially intends to exercise this authority pursuant to a codeshare agreement with American Airlines.

Issuance of the exemption that Gulf Air seeks in this Application will supercede and incorporate the current exemption authority that Gulf Air holds "to conduct scheduled foreign air transportation of persons, property and mail between... Boston/Miami/Chicago/Los Angeles and Abu Dhabi/Bahrain/Oman/Qatar, pursuant to a code-share agreement with American Airlines, Inc." Notice of Action Taken; Docket OST-95-309.

American Airlines holds a Statement of Authorization to display the Gulf Air code on American flights between London and Boston/New York (JFK)/Newark/Miami/Chicago/Los Angeles, between Frankfurt and Chicago/DalIas-Ft.Worth, and between Paris and Chicago/Dallas-Ft. Worth/Miami/New York. Statement of Authorization No. 99-07, March 8, 1999, as amended on January 5, 2005, in Docket OST-2004-19923.

Re: Polling Letter

On January 12, 2005, Gulf Air filed an Application in Docket OST-05-20097 for an exemption to provide scheduled service between a point or points in the United States, via intermediate points, and Abu Dhabi, Bahrain, Oman, and Qatar, pursuant to a codeshare arrangement with any U.S. or foreign airline, subject to the condition that any U.S. or foreign airline on which Gulf Air would codeshare would have to obtain a Statement of Authorization allowing the operating carrier to display the Gulf Air code on the flights in question. The Statement of Authorization condition will ensure that the Department will be able to address any regulatory or bilateral issue that may arise out of a specific codesharing arrangement. As Gulf Air stated in its Application, Gulf Air plans to introduce service pursuant to this exemption by codesharing on certain flights of American Airlines, which already holds the necessary Statement of Authorization.

Gulf Air has polled all of the carriers listed on the Service List of the Application, and none has any objection to the Application.

Gulf Air and American Airlines face a deadline of February 6, 2005, for loading the codeshare schedules into the appropriate computer reservations systems in order to meet the implementation date. An inability to meet this deadline would result in a substantial delay in the introduction of this new service and the loss in the interim of the additional competitive options that it would provide to the public.

Supplement to Application

Gulf Air Company hereby supplements its Application for an Exemption in the above docket such that the Application seeks exemption authority only with respect to Gulf Air operations conducted pursuant to a codeshare agreement between Gulf Air and American Airlines. This Supplement does not affect any other aspect of the initial Application.

Therefore, for the reasons previously set forth, it is in the public interest for the Department to grant the Application of Gulf Air Company, as hereby supplemented, for an exemption to provide scheduled foreign air transportation of persons, property, and mail between Abu Dhabi, Bahrain, Oman, and Qatar, on the one hand, via intermediate points, and a point or points in the United States, on the other, pursuant to a codeshare agreement with American Airlines.

Application for an Expedited Exemption

Gulf Air Company hereby applies for an exemption from 49 U.S.C. 41301 inorder to engage in scheduled foreign air transportation of persons, property, and mail between Abu Dhabi, Bahrain, Oman, and Qatar, on the one hand, via intermediate points, and a point or points in the United States, on the other, pursuant to a codeshare agreement with American Airlines.

Gulf Air previously held this authority pursuant to an exemption issued by Notice of Action Taken in Docket OST-2005-20097, effective through February 3, 2007. Due to the proximity of the expiration date of that exemption with the expiration date of another codesharing exemption held by Gulf Air -- January 6, 2007, in Docket OST-1996-1055, a renewal application was inadvertently not filed for the exemption in Docket 20097. Gulf Air therefore requests that the Department issue on an expedited basis an exemption granting the authority previously issued in Docket OST-2005-20097. Gulf Air will poll the parties on the Service List and advise the Department whether there are any objections to this Application.

We have polled all of the carriers listed on the Service Lists of the above-referenced Applications of Gulf Air and of American Airlines, and none has any objection to either Application.

In view of the lack of objections and the benefits of the codeshare service by Gulf Air and American as set forth in the Applications, Gulf Air and American request the Department to grant immediate approval to their respective Applications.

Exemption from 49 U.S.C. 41301 to permit the applicant to engage in scheduled foreign air transportation of persons, property, and mail between Abu Dhabi, Bahrain, Oman, and Qatar, on the one hand, and a point or points in the United States, on the other hand, via intermediate points, pursuant to a code-share arrangement with American Airlincs, Inc.

We are acting concurrently on a pending American application in Docket OST-2004-19923 for a statement of authorization to place Gulf Air’s “GF” designator code on flights operated by American over various transatlantic routes.

We are acting on Gulf Air’s application prior to the expiration of the 15-day answer period with the consent of all parties served.
