Joint Application for Blanket Codesharing Authorizations and Related Exemptions

Hereby jointly apply under 14 CFR Part 212 for blanket statements of authorization and under 49 USC 40109 for related exemptions in order to engage in reciprocal codesharing services pursuant to the attached agreement.

(A) American requests a statement of authorization, and Lan Peru requests necessary underlying exemption authority, to display Lan Peru's "LP" designator code in conjunction with foreign air transportation of persons, property, and mail on flights operated by American (or its affiliates) between (1) points in the United States; (2) points in the U.S. and points in Peru (either nonstop or via intermediate points in third countries) (3) points in the U.S. and points in third countries; and (4) points in Peru and points in third countries.

(B) Lan Peru requests a statement of authorization, and American requests necessary underlying exemption authority, to display American's "AT" designator code in conjunction with foreign air transportation of persons, property, and mail on flights operated by Lan Peru between (1) points in Peru; (2) points in Peru and points in the U.S. (either nonstop or via intermediate points in third countries) ; (3) points in Peru and points in third countries; and (4) points in the U.S. and points in third countries.

American seeks this authority to display its designator code on flights operated by Lan Peru.

American holds underlying exemption authority to provide scheduled combination service between the United States and Peru (see Notice of Action Taken dated October 17, 2002, in Docket OST-1997-3073).

Lan Peru holds underlying exemption authority to provide scheduled combination service (1) between Lima and the coterminal points Miami, Los Angeles, and New York, and (2) between Lima and Miami via Punta Cana, Dominican Republic. See Notice of Action Taken dated October 7, 2004, in Dockets OST-2002-11695, OST-2000-7265, and OST-1999-6192. Lan Peru also holds authority to display the code of Lan Chile Cargo, S.A., on Lan Peru's scheduled flights between Lima and both Miami and Los Angeles.

Application for Renewal of Exemption

LAN Peru hereby applies for renewal of its exemption authority to engage in scheduled foreign air transportation of persons, property and mail (1) between points in the United States, (2) between points in the United States and points in Peru (either nonstop or via intermediate points in third countries), (3) between points in the United States and points in third countries, and (4) between points in Peru and points in third countries.

On February 16, 2007, the Department of Transportation issued a Notice of Action Taken (Corrected Copy) in this docket approving LAN Peru’s exemption authority for a one year period. This exemption authority is currently set to expire on February 2, 2008.

Under the same Notice of Action (OST-2004-19965), DOT granted a two year exemption to American Airlines.

American Airlines, Inc. and LAN Peru continue to hold the necessary authority to operate the code-share services at issue, and the code-share agreement providing for the code-share operations remains in effect.

Re: Confirmation of Renewal Application

This will confirm that Lan Peru S.A.'s ("Lan Peru") January 17, 2008, application seeks renewal of its exemption to engage in scheduled foreign air transportation of persons, property, and mail (I) between points in the United States, (2) between points in the United States and points in Peru (either nonstop or via intermediate points ill third countries), (3) between points in the United States and points in third countries, and (4) between points in Peru and points in third countries, solely for the purposes of displaying Lan Peru's designator code on flights operated by American and holding out service between Peru and the United States, or between Peru and third countries. Lan Peru will not hold out or offer service solel between United States points, or solely between the United States and third countries, under this authority.
