Continental Airlines, Inc. OST-2004-19375 - Exemption and Frequency Allocation - US-Russia October 12, 2004 Application for an Exemption and a Frequency Allocation Continental seeks authority to institute daily nonstop B-767 flights between New York/Newark and Moscow's Domodedovo Airport (DME) on May 5, 2005. Continental intends to operate daily flights during the May-September peak season, five weekly flights in the spring and fall, and four weekly flights in the winter. Continental requests a waiver of the Department's standard dormancy condition for its U.S.-Russia frequencies so Continental will have the flexibility to adjust its schedules in accordance with fluctuations in demand. Continental asks the Department to grant it U.S.-Moscow exemption authority, seven weekly U.S.-Russia frequencies and a waiver of the standard dormancy conditions promptly to enable Continental to seek foreign authority and engage in advance sales and marketing activities for their new route. Continental currently holds New York-Moscow authority for codesharing with Delta, and Continental was also awarded 35 Russia frequencies for that purpose. October 14, 2004 Re: Polling Answer of United Air Lines United has no objection to Continentals application for exemption, designation and frequency allocation under the US/Russia air services agreement so long as these actions do not affect United's authority to implement codeshare service to Russia (including the allocation of 7 frequencies) pursuant to Order 96-10-1. October 20, 2004 Continental has polled all airlines served with its October 12, 2004 application for U.S.‑Moscow, Russia exemption authority, seven weekly frequencies and waiver of the Department's usual dormancy condition for these frequencies. None of those airlines objects to the application. American and United each responded that it had no objection so long as its third‑country codeshare rights are not affected by the Department's allocation of frequencies to Continental. Since there are more than enough frequencies available to accommodate Continental's flights and the American and United codesharing, the codeshare frequencies held by American and United will not he affected by granting Continental's application. December 6, 2004 Amendment to Application for an Exemption and a Frequency Allocation Continental amends its application for an exemption and frequencies to authorize Continental to provide scheduled foreign air transportation of persons, property and mail between New York/Newark and Moscow, Russia, to revise the proposed startup date to March 25, 2006. A later startup date will provide more time for Continental to implement the proposed service at Moscow's Domodedovo Airport (DME). Continental urges the Department to issue the requested authority as soon as possible, however, so Continental can secure necessary foreign government authority, make suitable airport arrangements and market the proposed service well in advance of the startup date. October 23, 2006 Application for Renewal of an Exemption Continental applies for renewal of its exemption from 49 U.S.C. § 41101 authorizing Continental to provide scheduled foreign air transportation of persons, property and mail between New York/Newark and Moscow, Russia. Continental does not currently offer U.S.-Russia service, and it is now evaluating its options for providing service between the U.S. and Moscow. Continental is considering both codeshare service and operation of its own flights, and Continental plans to request the U.S.-Russia frequencies required to enable Continental to offer the service it proposes shortly. Continental asks the Department to renew its New York/Newark/Moscow exemption authority, effective for a minimum of two years. Since Continental has been awarded a blanket route integration certificate by Order 2006-1-1, it does not require renewal of the route integration authority in this exemption.
