Application for an Exemption

By Notice of Action Taken dated July 11, 2003, the Department granted exemption authority to Northwest to provide scheduled foreign air transportation of persons, property and mail between: the United States and The Netherlands, via intermediate points; points within The Netherlands; and points in The Netherlands and third countries. See Docket OST-2003-15191. The Department also granted blanket statements of authorization to Northwest and KLM to engage in reciprocal codesharing. See id. The exemption authority granted to Northwest in Docket OST-2003-15191 currently is limited “to countries with which the United States has signed open-skies agreements and/or countries for which the carrier holds authority to serve under certificates or exemptions issued by the Department . . . .” See id. Therefore, the exemption authority requested in this application is necessary for Northwest to serve Tripoli pursuant to a codeshare with KLM because there is no open-skies agreement between the United States and Libya and because Northwest does not currently hold either exemption or certificate authority to serve Libya. Today, Northwest and KLM filed a Notice of Additional Codesharing for the Amsterdam-Tripoli route in Docket OST-2003-15191.
