OST-04-19109 - Scheduled Passenger Operations as a Commuter Air Carrier September 8, 2004 Application for Authority to Conduct Scheduled Passenger Operations Casino Airlines intends to operate two BAe Jetstream 3100 19 passenger turboprop airliners in Texas and Louisiana serving Lake Charles and Dallas Love Field with scheduled flights twice a day, 7 days per week. Lake Charles has agreed to a private/public partnership utilizing D.O.T. Small Community Air Service funds as outlined in the Memorandum of Agreement which provides up front funding of $100,000.00, revenue guarantees of $1000.00 per flight (47% BLF) and no lease, landing or any other operating costs for a period of 1 year from commencement of operations. Casino intends to operate charter flights when the opportunity presents itself. Maintenance will performed the airline at Casino's headquarters at DAL. Casino Airlines was formed by Mr. Lewis McPherson and incorporated on April 17, 1996, and began revenue operations as a Part 121 Air Carrier on December 15, 1997 under certificate number C37A664H. Casino continued to operate in the Texas and Louisiana region until mid 1999. In 2000 Casino moved its base of operations and Air Carrier Certificate to Santa Maria, California to begin operations for a new client, Pacific Skyway. Casino operated routes for Pacific Skyway until April 2001 at which point Casino ceased flight operations as Pacific Skyway filed bankruptcy and was no longer financially capable of paying Casino Airlines for this service. Because of Pacific Skyway's bankruptcy Casino was not able to return to Texas until the Federal Bankruptcy Court Trustee released Casino to continue our move back to Texas in 2002. Casino Airlines has never filed bankruptcy. Plans to move Casino's operations and certificate back to Texas were also severely delayed by the events of September 11, 2001. Casino's remaining personnel were relocated to Texas in 2002 and began the process of requalification in 2003. The Federal Bankruptcy Trustee would not held or stop the operation of an independent entity company or the assets of that company if it was a service company only and creditor that was independent of the debtor. Casino Airlines was in fact an asset of Pacific Skyways and it was returned by the Judge, with some reservations, back to the original owner only because the certificate had been suspended because of dormancy and the airline had no value. October 28, 2004 Re: Letter Agreeing with Ruling on Confidential Treatment I am in receipt of the letter dated October 28, 2004, regarding Rule 12 confidentiality. I am in agreement with the assessment. Exhibits R & S were not supposed to be treated as confidential and were therefore not separated and treated as such, the paragraph likely referred to in the letter specifying Exhibits R & S was a typographical error. There is not an Exhibit S in the application although a cover sheet was inadvertently added during the copy process. In this connection, we note that information in our files indicates that the company was to be purchased by Pacific Skyway. It is not clear, however, whether this transaction was actually consummated. Please clarify whether Pacific Skyway owned Casino at any time or whether other shareholders (including you) owned the carrier at all times. If Casino was never owned by Pacific Skyway, provide verification of that fact as well as verification that Casino was not part of Pacific Skyway's bankruptcy proceedings and that there are no claims against Casino or its assets. Casino Airlines was unable to restart immediately due to the bankruptcy proceedings of Pacific Skyways filed April 30, 2001 and the events of September 11, 2001. Casino Airlines set up twice in California to resume service. After the Van Nuys FSDO in California refused Casino Airlines service we returned to the Dallas-Fort Worth area and have been working with the DFW FSDO. The Avion Group, see attached, is not a US Citizen as defined by the DOT, and reportedly is providing 90 percent financing and anywhere from 19 to 49 percent interest in the company. As the new owners hold various required positions within the airline as required by the FAA, but not all of the required positions, is this a possible cause of undue influence on those required positions as some are now 'more equal' than others. The article implies a major expansion and change in authority. I believe this change of ownership needs to be reviewed by the FAA and OST. Inc. d/b/a City Airlines filed an application in Docket OST-2004-19109 requesting authority pursuant to 49 U.S.C. 41738 to provide scheduled passenger services as a commuter air carrier. The applicant subsequently informed the Department that it was no longer pursuing its request for commuter air carrier authority.
