Application for an Exemption

North America plans to commence marketing the service from OAK to CUN and MEX on, or about, September 30, and to initiate the service on, or about, November 7, 2004. North American requests the exemption be granted effective immediately to allow the Company to pursue marketing and sales activities. North American plans to provide year round service in each market using B 757-200 with 214 seats, or similar aircraft on the following schedule:

Motion for a Temporary Dormancy Waiver

North American planned to institute its Mexican service on or about November 7, 2004. Unfortunately, due to delays in transmitting the designation, and further delays by the Mexican Government in approving its application, North American did not receive its Mexican authority for this service until November 18, 2004. This made it impossible to market and initiate the service before the end of 2004. Now, the Department of Defense has requested North American (and other carriers) to make available aircraft to enable DOD to complete a major Iraq troop rotation in February and March, 2005. North American has been active in transporting troops to and from the Middle East for the Iraqi Freedom effort and believes it has a civic responsibility to honor the DOD request.

Motion for a Temporary Dormancy Waiver

North American Airlines, Inc. hereby moves the Department for an additional temporary dormancy waiver through June 15, 2005, for its scheduled combination authority between Oakland, California and Cancun, Mexico authorized by Notice of Action Taken in this Docket on September 22, 2004. North American will not be initiating service in the Oakland-Mexico City market.

On February 3, 2005 the Department granted North American a temporary dormancy waiver through April 6, 2005 for Oakland-Cancun and Oakland-Mexico City scheduled combination service as its aircraft were being used in connection with troop transitions in Iraq. North American seeks a further extension of the start up date for Oakland-Cancun through June 15, 2005, to enable it to start service during the peak summer season. Since there is an unused U.S. designation in this market no U.S. carrier would be prevented from entering the market during this brief additional delay.

For the foregoing reasons, North American respectfully requests the Department to extend the dormancy period for initiation of scheduled service in the Oakland-Cancun market for 60 days until June 15, 2005.
