Application for an Exemption

American Eagle proposes to begin daily Dallas/Ft. Worth-San Luis Potosi nonstop service on December 2, 2004, using either 44-seat ERJ-140 or 50-seat ERJ-145 aircraft. American Eagle is seeking exemption authority, rather than a designation for service with small aircraft (60 seats or fewer) under 14 CFR Part 298, in order to obtain the flexibility to use 70-seat CRJ-70 aircraft on this route in the future. No U.S. carrier presently operates nonstop service in this market.

Southbound, American Eagle will depart Dallas/Ft. Worth at 1815 and arrive in San Luis Potosi at 2037. Northbound, American Eagle will depart San Luis Potosi at 0705 and arrive in Dallas/Ft. Worth at 0915.

Application for Renewal of Exemption Authority

American Eagle Airlines hereby applies for renewal of its exemption initially granted by Notice of Action Taken in this docket on September 22, 2004, authorizing scheduled foreign air transportation of persons, property and mail between Dallas/Ft. Worth, Texas and San Luis Potosi, Mexico.

American Eagle's Dallas/Ft. Worth-San Luis Potosi exemption would expire on September 22, 2006 absent this renewal application. American Eagle operates daily nonstop service between Dallas/Ft. Worth and San Luis Potosi using 46-seat ERJ-145 aircraft.

In response to the Department's Notice of August 23, 2005 on streamlining regulatory procedures (OST-2005-22228), American Eagle has requested corresponding certificate authority for the Dallas/Ft.
