Village Aviation, Inc. d/b/a Village Air Cargo OST-2004-18841 - Certificate of Public Convenience and Necessity August 4, 2004 Application for Amendment to Certiifcate of Public Convenience The enactment of the Rural Services Improvement Act in 2002, which altered the distribution of mail among Alaska bush carriers, has been detrimenral to Village's business and has recuired Village to search for new markets where it can profitably deploy its fleet. Accordingly, Village seeks to permanently remove the condition in its certificate that restricts its operations to the State of Alaska to enable it to take advantage of other business opportunities that may come its way in other parts of the country or other regions, as it has recently been able to do in American Samoa and the Independent State of Samoa. On April 20, 2004, the Department granted an emergency exemption relieving Village of the condition in its certificate limiting its operations to those within the State of Alaska. See Notice of Action Taken, Docket OST-2004-17582, issued April 20, 2004. This exemption was granted to permit Village no provide charter air transportation between Pago Pago, American Samoa, and Ofu and Fitiuta, American Samoa during the period April 20 through September 30, 2004, using one CASA 212 aircraft. With this exemption authority Village was able to transport medical supplies and food to the residents of American Samoa after the island had been hit by Cyclone Heta. By Notice of Action Taken, Docket OST-2004-18493, dated July 16, 2004, the Department again Village relieved Village of this condition and granted Village exemption authority to provide foreign charter cargo air transportation between Pago Pago, American Samoa and Apia, Independent State of Samoa. We have completed an initial review of the application filed on August 4, 2004, by Village Aviation, Inc. dlb/a Village Air Cargo, for an amendment to its interstate scheduled certificate. September 8, 2004 This letter responds to your August 6, 2004 letter requesting certain additional information concerning Village Aviation, Inc. d/b/a Village Air Cargo in order to process the carrier’s application for amendment of its certificate of public convenience and necessity. The numbered paragraphs below correspond to the numbered paragraphs of your August 6th letter. Attached hereto as Exhibit 1, please find Village's most recent balance sheet and income statement for the twelve‑month period ending June 30, 2004. September 21, 2004 Re: Ruling on Confidential Treatment The information for which Village seeks confidential treatment is the carrier's balance sheet and income statement for the twelve months ended June 30, 2004. Village contends that this information warrants confidential treatment because release of such information would permit competitors to make strategic judgments based on data to which it would not otherwise have access to the detriment of Village. It is not the Department's practice to withhold from public disclosure information relating to an applicant's current and historical financial statements. Village has provided no compelling reason for us to deviate from our normal practices.
