America West Airlines, Inc. and Royal Jordanian Airlines OST-2004-18613 - Approval of and Antitrust Immunity for Commercial Cooperation Agreement July 12, 2004 Joint Application for Approval of and Antitrust Immunity for Commercial Cooperation Agreement The Cooperation Agreement Will Generate Improved U.S.‑Jordan Service at Lower Cost As described above, the Cooperation Agreement will generate significant benefits to the public. Most importantly, the America West and Royal Jordanian alliance will create new on line service between Jordan and four of the largest markets in the Western U.S.: Phoenix, Las Vegas, Los Angeles and San Francisco. This new service will not only provide one‑stop service via Royal Jordanian's U.S. gateways in Chicago (ORD), Detroit (DTW), and New York (JFK) to America West's major hubs at Phoenix and Las Vegas, it will also seamlessly connect Royal Jordanian's transatlantic service from Amman to JFK, with America West's new, low‑fare transcontinental service from JFK to LAX and SF0. Consumers will benefit from greater choice and improved, lower‑cost service between the U.S. and Jordan, and will enjoy the benefits of integrated frequent flyer programs, baggage checking, and reservations and ticketing systems.
The breakdown between Jordanian traffic and other Middle Eastern traffic carried by Royal Jordanian is the same in both directions (U.S.-bound and Jordan-bound): 30 percent is to/from the Middle East and 70 percent is to/from Jordan. In total, in 2003, Royal Jordanian operated 1,047 roundtrip departures providing 230,000 seats and serving 137,007 roundtrip onboard passengers between the U.S. and Middle East in 2003. In January-February 2004, Royal Jordanian operated 118 roundtrip departures providing 29,000 seats and serving 22,339 roundtrip onboard passengers between the U.S. and Middle East. Competition from one-stop connecting services to Jordan is robust with such connections being provided by ten other carriers via their gateways as follows: KLM (Amsterdam), Lufthansa (Frankfurt), Alitalia (Milan), Air France (Paris), British Airways (London), Turkish Airlines (Istanbul), Cyprus Airways (Larnaca), TAROM (Bucharest), Egyptair (Cairo) and Middle East Airlines (Beirut). Served August 16, 2004 Notice Establishing Procedural Dates In order to afford interested parties prompt access to the documents under conditions agreed to by the applicants and imposed by the Department under similar recent circumstances,3 we will grant immediate interim access to all documents covered by the Rule 12 Motion to counsel and outside experts for interested parties who file appropriate affidavits with the Department in advance. Moreover, consistent with earlier determinations, at the Dockets facility, Parties will be permitted to make copies of the exhibits for use by persons who have filed confidentiality affidavits. We also find it appropriate to grant interim access to any subsequent materials that may be filed in this case under a Rule 12 Motion to counsel and outside experts for interested parties who file appropriate affidavits with the Department in advance, unless the party filing the Motion objects. Served September 17, 2004 Notice Establishing Procedural Dates | Word On July 12, 2004, America West Airlines, Inc. and Royal Jordanian Airlines filed a joint application requesting approval of and antitrust immunity for a commercial cooperative agreement (Exhibit JA-1), hereafter the "Alliance Agreement". On July 12, the applicants filed a joint Motion under 14 C.F.R. 302.12 (Rule 12) of our regulations seeking confidential treatment for supporting documents and information. They state that the material filed under the Motion is proprietary, commercially sensitive, and confidential in nature, which qualifies for being withheld from public disclosure. The applicants have asked that access to this material be limited to counsel and outside experts for interested parties. We have now finished our initial review. We find the application is now substantially complete. We will require that answers to the application be filed no later than 21 calendar days from the issue date of this Notice, and that replies be filed no later than 7 business days after the last day for filing an answer. Order 05-01-23 Issued and Served January 27, 2005 Order Granting Approval and Antitrust Immunity for a Comercial Cooperation Agreement | Word By this Order, we grant final approval of and antitrust immunity for a Commercial Cooperation Agreement between America West Airlines, Inc. and Royal Jordanian Airlines under 49 U.S.C. §§ 41308 and 41309. The Department’s action is subject to conditions, as explained further in this Order. The U.S.-Jordan market is an important part of the U.S‑Middle East market. The U.S.‑Jordan open skies agreement eliminated barriers to new entry, expansion, and competition created by government regulation. It was the thirteenth open skies agreement signed and the first open skies agreement with a Middle Eastern country. The agreement creates unrestricted competitive opportunities for all U.S. and Jordanian airlines, including the flexibility to operate their own direct services, or joint services with another airline. The agreement recognizes the value of airline networks and provides opportunities for competing airlines and alliances. By: Karan Bhatia
