Joint Application for Exemption and Statement of Authorization

Aeromexico requests a statement of authorization permitting Aeromexico to display Mexicana's two‑letter "MX" code on flights operated by Aeromexico in the Mexico City/Guadalajara/Hermosillo‑Phoenix markets. Aeromexico already holds from the Department underlying authority to operate on these routes.

Mexicana requests an exemption permitting it to serve  Mexico City/Guadalajara/Hermosillo-Phoenix under a codeshare arrangement with Aeromexico.

The most recent codeshare arrangement approved by the Department involved Morelia-Los Angeles, Monterrey-Las Vegas and Mexico City-Los Angeles. Notice of Action Taken

Exemption from 49 U.S.C. section 41301 to permit Mexicana, for a period of one year, to conduct scheduled, combination service between the three Mexican coterminal points Mexico City/Guadalajara/Hermosillo, and Phoenix, Arizona, only by codeshare arrangement with Aeromexico; and, 2) Statement of Authorization under 14 CFR Part 212 to permit Aeromexico, for an indefinite duration, to carry Mexicana's designator code on Aeromexico’s flights between those three Mexican coterminal points and Phoenix.

Application for Renewal of Exemption

Mexicana holds exemption authority to operate scheduled services between Mexico City/Guadalajara/Hermosillo, Mexico, and Phoenix, Arizona.' Mexicana is limited to operation of this service only under its codeshare arrangement with Aeromexico by displaying the MX* code on Aeromexico's flights. Currently, Mexicana offers nonstop codeshare service between Guadalajara and Phoenix in conjunction with Aeromexico.

Application for Renewal of Exemptions

Compania Mexicana de Aviacion, S.A. de C.V. hereby requests renewal of the exemption authorities granted to it by the Department of Transportation in the above-captioned dockets to perform scheduled foreign air transportation of persons, property and mail between:

  1. the coterminal points Mexico City, Guadalajara and Hermosillo, Mexico, on the one hand, and Phoenix, Arizona, on the other hand, pursuant to Mexicans's codeshare arrangement with Aerovias de Mexico, S.A. de C.V.
  2. the coterminal points Morelia and Zacatecas, Mexico, on the one hand, and Dallas/Ft. Worth, Texas, on the other hand.
  3. the coterminal points Durango, La Paz and Manzanillo, Mexico, on the one hand, and Los Angeles, California, on the other hand.
  4. Hermosillo, Mexico, and Las Vegas, Nevada.

Mexicana requests renewal of these exemptions for a one-year period on their existing terms and conditions.

Mexicana currently offers codeshare service between Guadalajara and Phoenix under its codeshare arrangement with Aeromexico. Although nonstop services are not offered or operated currently in the other markets, Mexicana wishes to renew its authorities so that operations may resume without delay as warranted by commercial conditions.
