Joint Application for Exemptions

America West Airlines, Inc. and its codeshare partner, Mesa Airlines, Inc. provide extensive service between the Western U.S. and various points in Mexico. America West and Mesa plan to expand their service to Mexico to include six additional routes as of December 18, 2004.

  • America West will operate its mainline service on two routes: - Los Angeles, California (LAX) - Acapulco, Mexico (ACA), and - Oakland, California (OAK) -Los Cabos, Mexico (SJD)
  • Mesa, d/b/a/ America West Express, will operate flights carrying America West's "HP" designator code on four routes: - Las Vegas, Nevada (LAS) - SJD, - LAS - Puerto Vallarta (PVR), - San Diego (SAN)-SJD, and -SAN -PVR.

America West seeks an exemption from 49 U.S.C. 41101, effective for at least two years beginning August 1, 2004, to provide foreign air transportation of persons, property and mail in the six markets discussed above operating the initial schedules shown in Exhibit A hereto. 4 America West proposes to operate mainline service in the LAX‑ACA and OAK‑SJD markets using A319 or B737 aircraft. America West proposes to serve the remaining markets listed above through its codesharing relationship with Mesa.

Mesa requests an exemption from 49 U.S.C. § 41101 to provide foreign air transportation of persons, property and mail in the LAS‑SJD, LAS‑PVR, SNA‑SJD and SAN‑PVR markets. Pursuant to their codeshare relationship, Mesa will conduct the operations as America West Express in these markets using CRJ Model 900 (86 or 90– seat) equipment.

Scheduled foreign air transportation of persons, property, and mail between (1) the terminal point Los Angeles, California, and the terminal point Acapulco, Mexico; and (2) the terminal point Oakland, California, and the terminal point San Jose del Cabo, Mexico. The applicants state that the subject exemption authority will be used by America West to provide nonstop direct-carrier flights in the Los Angeles-Acapulco and Oakland-San Jose del Cabo markets.

Joint Application for Renewal of Exemption Authority

America West currently provides scheduled air service in the LAX-ACA and OAK-SJD markets using Airbus A-319 and/or Boeing 737 aircraft. Mesa currently provides scheduled air service in the LAS-SJD, LAS-PVR, SAN-SJD, and SAN-PVR markets using CRJ regional jet aircraft. America West’s “HP” code appears on these flights pursuant to the code-share agreement.

America West and Mesa’s current exemption authority to engage in scheduled foreign air transportation of persons, property, and mail between the U.S.-Mexico city-pairs described in Appendix A is effective through July 23, 2006.

Markets in which America West Will Operate Nonstop Scheduled Air Service:

  • Los Angeles, California (LAX) – Acapulco, Mexico (ACA)
  • Oakland, California (OAK) – San Jose del Cabo, Mexico (SJD)

Notice of Dormancy

On August 3, 2006, the Department of Transportation renewed America West Airlines. Inc.'s existing exemption authority to provide scheduled foreign air transportation between Los Angeles, California. and Acapulco, Mexico for a period of two years. (See Notice of Action Taken, August 3, 2006, Docket OST-2004‑18440).

In accordance with the Conditions set forth in the Notice, America West hereby advises the Department that it will no longer operate Los Angeles-Acapulco service effective January 7, 2007. Accordingly, America West respectfully provides notice of dormancy with respect to this route.

Cessation of Route

On August 3, 2006, the Department of Transportation renewed America West Airlines, Inc.'s existing exemption authority to provide scheduled foreign air transportation between Oakland, California, and San Jose del Cabo, Mexico for a period of two years.

In accordance with the Conditions set forth in the Notice, America West hereby advises the Department that it will no longer operate Oakland-San Jose del Cabo service effective immediately. Accordingly, America West respectfully provides notice of dormancy with respect to this route.

Re: Partial Cancellation of Codesharing

On November 4, 2005, the Department authorized US Airways, Inc. to code-share on flights operated by America West Airlines, Inc. and Mesa Airlines, Inc. between various points in the United States and Mexico. (See Erratum, Docket OST-2005-22645). On September 26, 2007, America West and US Airways combined their operations under US Airways' Operating Certificate, and all international air service is now being conducted pursuant to certificate and exemption authority previously granted to US Airways.

Accordingly, US Airways hereby requests that the Department cancel its exemption authority to codeshare on flights previously operated by America West in the markets listed:

US Airways intends to continue to place its code on Mesa-operated flights in these markets, as evidenced by its renewal application. (See Application of US Airways for Renewal of Exemptions, September 6, 2007, Docket OST-2005-22645).

Mesa applies for renewal of its exemption authority to engage in scheduled foreign air transportation of persons, property, and mail between U.S.-Mexico city-pairs.

By Notice of Action Taken (August 3, 2006), the Department granted Mesa a two-year exemption from 49 U.S.C. § 41101 to engage in scheduled foreign air transportation of persons, property, and mail between U.S.-Mexico city-pairs.
