Application for an Exemption

Hereby applies for an exemption authorizing scheduled foreign air transportation of persons, property, and mail between Dallas/Ft. Worth, Texas, and Chihuahua, Mexico. American Eagle proposes to begin daily Dallas/Ft. Worth-Chihuahua nonstop service on October 1, 2004, using either 44-seat ERJ-l40 or 50-seat ERJ-145 aircraft. American Eagle is seeking exemption authority, rather than a designation for service with small aircraft (60 seats or fewer) under 14 CFR Part 298, in order to obtain the flexibility to use 70-seat CRJ-70 aircraft on this route in the future.

No U.S. carrier presently operates nonstop service in this market. Accordingly, American Eagle's request is fully consistent with the bilateral agreement.

Motion for Temporary Waiver Dormancy Condition

The subject authority was granted by Notice of Action Taken in this docket on June 25, 2004, subject to a 90-day start-up condition to begin on October 1, 2004, the date that American Eagle initially proposed to start service. Absent a dormancy waiver, the authority would automatically expire on December 30, 2004.

American Eagle now plans to inaugurate Dallas/Ft. Worth-Chihuahua operations on May 4, 2005. Granting a temporary dormancy waiver is in the public interest, as American Eagle has firm plans for starting service. Under the U.S.-Mexico Air Transport Agreement, as amended, two U.S. carriers may be designated between Dallas/Ft. Worth and Chihuahua. No other U.S. carrier is operating nonstop service in this city-pair, and the temporary waiver American Eagle is seeking will facilitate entry.

American Eagle Airlines hereby applies for renewal of its exemption, initially granted by Notice of Action Taken in this docket on June 25, 2004, authorizing scheduled foreign air transportation of persons, property, and mail between Dallas/Ft. Worth, Texas and Chihuahua, Mexico.

American Eagle operates daily nonstop service between Dallas/Ft. Worth and Chihuahua using 46-seat ERJ-145 aircraft.
