SkyWest Airlines, Inc. d/b/a United Express OST-2004-17955 - Statement of Authorization - US-Canada Codeshare with Air Canada May 21, 2004 Application for a Statement of Authorization Initially, SkyWest's code-share service for Air Canada will be offered three Denver transborder markets: Denver-Edmonton, Denver-Calgary/ and Denver-Winnipeg. SkyWest will provide the Department with a notice with respect to the addition of new city pairs. Denver‑Calgary services is a new United Express route for Air Canada which SkyWest will be operating. Denver‑Edmonton and Denver‑Winnipeg are United Express routes operated by Air Wisconsin on which Air Canada has previously been code sharing and wishes to continue to do so after those services are taken over by Sky West. SkyWest requests a blanket code-share statement of authorization similar to that awarded it was awarded to display Asiana's and Lufthansa's codes. May 27, 2004 As you may know, SkyWest Airlines, Inc. several days ago applied to DOT for a Statement of Authorization which would enable SkyWest to display the Air Canada “AC” airline designator code on certain trans-border flights to be operated by SkyWest. As I understand, the Department requires that copies of code-share arrangements between US and non-US carriers be submitted to the Department. A copy of the Air Canada-SkyWest agreement is attached. The reason I am copying Randy Bennett on this letter is that under Order 97-9-21 at 10-11, n.40 (the order conferring antitrust immunity upon United and Air Canada), the Department required, inter alia, that “[c]ontractual instruments and agreements in principle between the Joint Applicants and additional carrier par ners, regardless of whether antitrust immunity is sought for any activities related to such partners and/or whether the instruments/agreements may be drafted as separate agreements which merely supplement the ‘Alliance Expansion Agreement’ … be filed for review.” We believe that the Air Canada/SkyWest agreement is not an agreement between the “Joint Applicants” and an additional carrier party inasmuch as United is not a party to it. Nor does the agreement “supplement” the Alliance Expansion Agreement between United and Air Canada. Air Canada therefore reasonably believes that this contract is not subject to filing and review under footnote 40. However, out of an abundance of caution and because the agreement must in any event be submitted pursuant to other requirements, Air Canada is submitting it to the Office of Aviation Analysis as well to the Licensing Division of the Office of International Aviation. July 30, 2004 Notice of Additional Codeshare Service Hereby notifies the Department that SkyWest will place Air Canada's "AC" designator code on the carrier's United Express flights between Chicago, Illinois and Edmonton, Alberta, Canada. OST-2002-12050 - US-Canada Codeshare with Air Canada August 9, 2004 Joint Notice for Additional Codeshare Service Hereby notify the Department of city pairs in which they propose to display the designator codes of Air Canada and Lufthansa (see Attachment A hereto). AWAC and SkyWest intend to operate code-share services under this notice to the extent necessary to supplement the services of United Airlines as United Express carriers. OST-2003-16724 - SkyWest - Statement of Authorization - Codeshare with Lufthansa German Airlines October 14, 2005 Joint Notice of Additional Codeshare Pursuant to Statements of Authorization the Department has granted them SkyWest Airlines, Inc., Mesa Airlines, Inc. and Trans States Airlines, Inc. hereby jointly notify the Department that they intend to display the designator codes of Air Canada, Lufthansa German Airlines, All Nippon Airways Co. Ltd., Austrian Airlines, Osterreichische Luftverkehrs AG, and British Midland Airways Limited on flights operated by SkyWest, Mesa and/or Trans States doing business as United Express on behalf of United Airlines, Inc. between Chicago, IL, Denver, CO, Los Angeles, CA, San Francisco, CA and Washington, DC, on the one hand, and the following U.S. cities, on the other hand: Daytona Beach, FL; Fort Lauderdale, FL; Great Falls, MT; and Kona, HI. January 17, 2008 Re: Codeshare Notice with Star Alliance Members SkyWest hereby notifies the Department that it will display the designator codes of Air Canada, Asiana Airlines, British Midland Airways Limited, Deutsche Lufthansa AG, Qatar Airways, Q.C.S.C., TACA International Airlines, S.A., and Lineas Aereas Costarricenses S.A. on flights operated by SkyWest, dlb/a United Express, between and among the cities listed in Exhibit A hereto. Since these markets may be served interchangeably by United and United Express services, a similar notice is being filed on this date for United in the appropriate dockets. This notice will enable United and United Express carriers such as SkyWest to operate code-share services interchangeably to the points listed without the need to file repetitive notices as services shift from one carrier to another. The proposed code-share services are fully consistent with the applicable bilateral air transport agreements. OST-2002-13320 - United - Codeshare with Asiana February 6, 2008 We are in receipt of five 30-Day Notices from United each dated January 17, 2008, notifying the Department of the carrier's proposed expanded code-share services involving (1) United and various foreign carriers; (2) United's affiliate, Mesa Airlines, Inc., and various foreign carriers; (3) United's affiliate, GoJet Airlines, LLC, and various foreign carriers; (4) United's affiliate, Shuttle America Corporation, and various foreign carriers; and (5) United's affiliate, Sky West Airlines, Inc., and various foreign carriers. We have reviewed the services proposed and have no objection to the Notices. In this regard, however, we note that no services that become newly available under the first phase U.S.-EU Air Transport Agreement can be implemented before March 30, 2008. By: Paul Gretch
