United and Thai now seek authority for United to place Thai's TO code on additional United‑operated services between Osaka, Japan, on the one hand, and Chicago, Honolulu, and San Francisco, on the other hand, and for Thai to place United's code on Thai‑operated services between Osaka and Bangkok.

Scheduled foreign air transportation of persons, property and mail between points in Thailand and Honolulu via Osaka, Japan, and to add Osaka as an intermediate point on its existing services between points in Thailand and Chicago and between points in Thailand and San Francisco. Thai intends to operate this service under a code-share arrangement with United Air Lines.

Application for Renewal of an Exemption

Hereby applies for renewal of its exemption from the requirements of 49 U.S.C. § 41301 to enable it to continue to offer services under its code share with United Air Lines, Inc. between points in Thailand, on the one hand, and Honolulu, Chicago and San Francisco, on the other hand, via Osaka, Japan.

The Notice of Action Taken dated May 17, 2004, in this docket, also granted statements of authorization for an indefinite period of time to Thai to display United's designator code on flights operated by Thai between Osaka and Bangkok and to United to display Thai's designator code on flights operated by United between Osaka, on the one hand, and Chicago, Honolulu and San Francisco, on the other hand.

Thai separately holds exemption authority for service between Thailand and the coterminal points Chicago and San Francisco. Notice of Action Taken dated October 18, 1996 (Docket OST-96-1410). Thai also has on file with the Department an application for a new foreign air carrier permit that would vest Thai with the full range of authority that the United States agreed to grant designated carriers of Thailand in the bilateral air services agreement concluded in 1996. ( Application of Thai Airways International Public Company Limited for Amendment of its Foreign Air Carrier Permit, filed on March 21, 1997, in Docket OST-97-2253).

Renewal of Application for Certificate of Public Convenience and Necessity for Foreign Scheduled Air Transportation

On March 8, 2005 JetBlue Airways Corporation filed an Application for Certificate Authority to the Bahamas, Bermuda, Canada, the Dominican Republic, and Jamaica. On August 23, 2005 the Department of Transportation issued a Notice in Docket-2005-22228 announcing new processing procedures for issuance of certificate authority for US and foreign air carriers. In light of that Notice and because JetBlue wishes to receive the certificate authority for which it filed in 2004, Jetblue herewith files this Renewal of its prior Application and request issuance of the requested certificate authority and the widest possible integration authority as contemplated by the Notice.
