Application for Grant of an Exemption

United seeks an exemption authorizing it to provide scheduled foreign air transportation of persons, property and mail between Chicago, Illinois and Cozumel, Mexico. United plans initially to operate this service on a thrice weekly basis (Mon/Wed/Sat) on a seasonal basis December through April. Services will begin on December 18, 2004. United will operate its Chicago‑Cozumel services from its hub at O'Hare International Airport. United serves over 120 points from Chicago, offering connection opportunities to Cozumel to points throughout its system.

Currently, no other U.S. carrier is providing nonstop service between Chicago and Cozumel. On March 19, 2004, ATA Airlines, Inc. filed an application in Docket OST-04-17377 for an exemption to operate services between Chicago and Cozumel starting in November and serving Midway Airport. There are two designations available to accommodate both United's and ATA's proposed services. Prompt issuance of United's requested exemption will serve the public interest as it will stimulate passenger travel and expand the service options available to consumers.

Notice of Polling

In order to expedite consideration of United's above-referenced application and of ATA Airlines' related application in Docket OST-04-17377, United has agreed to poll the interested carriers served with its application. Answer of The City of Chicago in Support

The City is committed to encouraging new air service and competition at O'Hare and Midway. Currently, no non-stop scheduled service exists between Chicago and Cozumel, Mexico. However, on March 19, 2004, ATA Airlines, Inc. applied for an exemption to provide service between Midway and Cozumel. Docket OST-04-17377. The City filed its support of ATA's application in the Docket on April 5, 2004.

January 25, 2006

Motion for a Dormancy Waiver

United hereby requests a waiver of the dormancy condition through December 16, 2006. Due to the devastation of Cozumel caused by Hurricane Wilma, United has determined that it is not feasible to operate service in this market for the 2005/2006 Winter season. However, United plans to resume its seasonal service in this market on or before December 16, 2006. The requested waiver will enable United to implement this service when conditions warrant.

Application for Renewal of an Exemption

United hereby requests renewal of its exemption authority for a minimum period of two years or until its current certificate for Route 566 is amended to include the Chicago-Cozumel route segment.

Due to the devastation of Cozumel caused by Hurricane Wilma, United is not operating service in this market for the Winter 2005-2006 season, but United intends to resume seasonal nonstop service between Chicago and Cozumel with its own aircraft on or before December 16, 2006. Renewal of this exemption authority is clearly in the public interest, and United requests renewal of its exemption based on the original findings that the proposed services are fully consistent with the bilateral air transportation agreement between the U.S. and Mexico.

Renewal of Scheduled foreign air transportation of persons, property, and mail between Chicago, Illinois, and Cozumel, Mexico.  United states that it will continue to provide seasonal nonstop service in this market.

In the present application, United references its pending application to amend its certificate for Route 566 to include Chicago-Cozumel.  See Docket OST-1999-5846.  We will handle the certificate request separately.

United states that due to Hurricane Wilma it did not operate service during the Winter 2005-2006 season, but that it intends to resume its seasonal service on or before December 16, 2006.

Application for Reactivation of Exemption Authority

United Air Lines, Inc. hereby requests the Department to reactivate its dormant U.S.-Mexico exemption authority, which was previously issued to United in the above-referenced proceeding to operate seasonal services between Chicago, IL and Cozumel, Mexico. This authority was last issued in a Notice of Action Taken, dated April 21, 2006, renewing United’s Chicago-Cozumel authority for a period extending to April 21, 2008. See, Docket OST-2004-17490. United gave notice of dormancy in a letter dated December 19, 2006, when it decided not to reinstate seasonal services at that time due to the destruction caused by Hurricane Wilma in 2005.

United has now decided to reinstate weekly, seasonal Chicago-Cozumel non-stop services, operating each Saturday from December 15, 2007 through the following April and a similar seasonal pattern each year thereafter. United will use A320 equipment with 138 seats (12F; 126Y). In these circumstances, United requests that its exemption authority be reactivated effective immediately to enable it to reinstate this service. There continue to be sufficient designations available under the U.S.-Mexico Air Services Agreement to allow the Department to reactivate United’s authority for the Chicago-Cozumel market. In fact, while all three designations in the Chicago-Cozumel market are currently available, only one other carrier (USA3000) has thus far requested the authority (Docket OST-2007-28577) to serve this market.

United hereby applies for renewal of the two above-captioned exemptions from 49 U.S.C. § 411 01 authorizing it to provide scheduled combination service in foreign air transportation of persons, property, and mail between Chicago, Illinois and Cozumel, Mexico and Chicago, Illinois and Cancun, Mexico. United's exemption authority for the Chicago-Cozumel market is currently effective through April 21, 2008. United's exemption authority for the Chicago-Cancun market is currently effective through April 25, 2008.

United intends to continue its seasonal service between Chicago and Cozumel, as well as its year-round service between Chicago and Cancun.
