Application for a Foreign Air Carrier Permit

Cargojet proposes to begin operating transborder passenger charters in April 2004 with a leased Boeing 727-200 aircraft, configured for 60 executive-class seats, that is suitable for sports team and executive/corporate charters. It also seeks the flexibility to commence scheduled passenger or all-cargo service in the future. It has applied to the Canadian Transportation Agency for amendments to its domestic and international licenses to cover all such operations. It expects that authority, corresponding amendments to its Canadian Air Operator's Certificate, and a passenger designation under the U.S.-Canada bilateral aviation agreement, to be issued in the near future. Cargojet will file copies of its amended authority in this Docket when it is issued.

Cargojet currently operates ad hoc U. S.‑Canada cargo charters under its exemption authority, and it anticipates that in April 2004 it will commence U.S.Canada passenger charter service with a Boeing 727‑200 aircraft, configured for 60 executive‑class seats. These charters will be operated for sports teams and other private or corporate charterers.

Cargojet Airways is one of several sister companies, all owned by Cargojet Holdings Ltd., that together provide a Canadian overnight air freight network serving all major Canadian cities. The Cargojet network operates under long‑term contracts for major integrated courier companies, forwarders, and large shippers. Cargojet Canada manages the network, Cargoj et Airways operates the air transportation involved, and the two Flagship companies identified in item (k) below own five of the aircraft used in the Cargojet service.

Cargojet began freighter operations several years ago as Winnport Logistics Ltd., and it was purchased by Cargoj et Holdings in 2002. Over the last two years Cargoj et has focused on overnight air cargo services within the domestic Canadian market, but it has operated occasional, transborder charters for freight forwarders and express freight companies.

Supplement No. 1 to Applications for a Permit and an Exemption

On March 31, 2004, the Canadian Transportation Authority issued Cargojet Airways Ltd. new licenses authorizing the carrier to conduct scheduled and charter air transportation of persons, property, and mail between Canada and the United States. Copies of these licenses are attached. The carrier's family assistance plan, passenger manifest plan, and Montreal Agreement are on file with the Department, and an updated certificate of insurance, OST Form 6411, has been filed with the Federal Aviation Administration.

WHEREFORE, Cargojet Airways Ltd. d/b/a Starjet Airways respectfully requests that the Department proceed to grant the above-docketed applications in their entirety and such other and further relief as the Department may deem appropriate.
