Application for an Exemption

Requests the Department of Transportation for the grant of an exemption from 49 U.S.C. § 41301 to the extent required to enable Applicant to engage in scheduled air transportation of property and mail between any point or points in Brazil and any point or points in the United States on any and all routes authorized pursuant to the Agreement between the Government of the United States of America and the Government of the Federative Republic of Brazil on Air Transport, as amended.

Re: Second Supplement to Application for Exemption Authority

We write to supplement Varig Log's Application. We refer you to Exhibit JX-5 of the: Application, Varig Log's Operating Authority.

We attach a certificate issued on December 17, 2004, by the Committee of Studies Related to International Air Navigation of the Federative Republic of Brazil, granting authority to VARIG LOG to perform two (2) weekly frequencies between points in Brazil and points in the United states pursuant to Annex I, Section I (Routes) of the Bilateral Air Services Agreement between the United States and Brazil. This enclosed Certificate supplements Exhibit LC-5 of the Application.

In connection with this filing, we wish to supplement and clarify that at the outset of its U.S. operations, and until such time as this Application is further supplemented or amended, as the case may be, VARIG LOG shall conduct scheduled foreign transportation of cargo and mail from a point or points in Brazil, via intermediate points, to New York, Atlanta, Miami, Orlando, Detroit, Washington/Baltimore, Houston, Chicago, Los Angeles, San Francisco, Boston and San Juan, Puerto Rico. In connection with these operations, VARIG LOG is not presently planning to engage in code sharing activities.

VARIG LOG hereby applies for renewal of its exemption from 49 U.S.C. § 41301 to engage in scheduled foreign air transportation of property and mail from a point or points in Brazil, via intermediate points, to New York, Atlanta, Miami, Orlando, Detroit, Washington/Baltimore, Houston, Chicago, Los Angeles, San Francisco, Boston and San Juan, Puerto Rico, and to conduct all-cargo charters subject to 14 C.F.R. part 212.

VARIG LOG's current authority is scheduled to expire on January 17, 2007. By this application, VARIG LOG requests that the Department renew this exemption authority for at least one additional year.
