Continental Airlines, Inc. OST-2004-16997 - Exemption - New York/Newark-Punta Cana, Dominican Republic January 28, 2004 Continental intends to institute New York/Newark (Newark Liberty International Airport)-Punta Cana service with B-737 aircraft on June 10, 2004. Although the proposed New York/Newark-Punta Cana service is not authorized by the U. S.-Dominican Republic bilateral air transport agreement because Punta Cana is not a named point for U.S. carriers, authority to serve Punta Cana has been awarded to American, Northwest and USA 3000 airlines on the basis of comity and reciprocity. February 4, 2004 Continental has polled all airlines served with its January 28, 2004 application for New York/Newark-Punta Cana, Dominican Republic, exemption authority and has received non-objections from all carriers. Continental hopes to begin selling this service starting as soon as possible, and prompt action granting this application and designating Continental for such service would be greatly appreciated so Continental can secure the necessary foreign government authority well in advance of its June 10, 2004 start-up date. December 30, 2005 Application for Renewal and Amendment Continental applies, pursuant to 49 U.S.C. § 41102 and Subpart B of the Department's Rules of Practice, for renewal and amendment of its exemption from 49 U.S.C. § 41101 authorizing Continental to provide scheduled foreign air transportation of persons, property and mail between New York/Newark and Punta Cana, Dominican Republic as well as integration authority to combine this exemption authority with Continental's other exemption and certificate authority. Continental asks that the Department renew its authority for a period of no less than two years. Continental also asks that its authority be amended to permit Continental to provide scheduled foreign air transportation of persons, property and mail between a point or points in the United States and a point or points in the Dominican Republic. Continental recognizes that its request for route integration authority will become moot if the Department issues a final order granting Continental's application for certificate authority granted tentatively by Order 2005-12-5. Filed December 30, 2005 | Issued January 25, 2006 Scheduled foreign air transportation of persons, property, and mail between a point or points in the United States and a point or points in the Dominican Republic. The application also seeks renewal of Continental’s existing city-pair specific exemption authority to serve the New York/Newark-Punta Cana, Dominican Republic market. We note that the broader amended authority that the applicant seeks, and that we are granting in this Notice, subsumes the existing city-pair specific authority. The carrier’s renewal request also seeks renewal of route integration authority specific to the New York/Newark-Punta Cana market. However, the application is silent on route integration as concerns the broader amended authority. November 27, 2007 Continental is currently providing significant benefits to travelers and shippers providing transportation between points throughout the United States and points in the Dominican Republic through Continental's hub at Newark Liberty International Airport.
