Applicationf or an Emergency Exemption

The outsized cargo to be transported by Volga‑Dnepr between the above listed points will consist of four Apache helicopters, each with the dimensions in shipping configuration of 603 x 119 x 145 inches, and the weight of 14,878 lbs, as well as twelve blade boxes, each 246 x 16 x 36 inches in dimensions, and associated spare parts. The total payload for the flight will amount to 35 metric tons. The cargo as described cannot be transported on any commercially available U.S. aircraft, and requires the use of the AN‑ 124‑100 aircraft.

Notice of Action Taken

Exemption from 49 U.S.C. section 40109(g) to permit the applicant to operate, on behalf of the Department of Defense, one, one‑way cargo charter flight, carrying helicopters from Pope Air Force Base, North Carolina, to Davis‑Monthan Air Force Base, Arizona, on January 23, 2004, using its AN‑124‑100 aircraft. The applicant stated that the Department of Defense currently does not have non‑civilian lift available to carry these helicopters, urgently needs prompt shipment of the cargo to Arizona to meet an extremely tight military exercise schedule, that the cargo is too large for transportation on U.S.‑carrier aircraft; and that surface transportation is not feasible because of the nature of the cargo and the urgent need for prompt delivery.
