America West Airlines, Inc.

OST-2003-16735 - Exemption - Los Angeles-Puerto Vallarta Codeshare with Mesa

December 16, 2003

Application for an Exemption

Respectfully requests an exemption effective for at least two years from 49 U.S.C. 41101 and any other relief necessary to authorize America West to display its "HP" designator code on combination flights operated by Mesa Airlines, Inc. between Los Angeles, California and Puerto Vallarta, Mexico using a CRJ Model 900,86- to 96-seat aircraft' America West intends to begin the codeshare operations on or about June 1, 2003, and therefore respectfully requests the Department grant it an exemption effective immediately to allow the Company to pursue advance marketing and sales activities. In addition, America West respectfully requests that the Department issue a notification of its authorization to codeshare with Mesa on the LAX- PVR route.

Notice of Action Taken | Word

Scheduled foreign air transportation of persons, property, and mail between Los Angeles, California, and Puerto Vallarta, Mexico.

America West states that it will use the requested authority pursuant to a code-share arrangement with Mesa Airlines, Inc., whereby America West will place its “HP” code on flights operated by Mesa in the subject market. Under the U.S.-Mexico aviation agreement, up to two U.S. carriers may be designated to operate direct-carrier service (own-aircraft flights), and up to four U.S. carriers may be authorized to provide code-share services in a given city-pair market. At the time this application was filed, Alaska Airlines, Inc., held one of the designations to serve the Los Angeles-Puerto Vallarta route, and the second designation was available. However, four carriers already held the Los Angeles-Puerto Vallarta code-share authorizations (Continental Airlines, Inc.; Delta Air Lines, Inc.; Northwest Airlines, Inc.; and Hawaiian Airlines, Inc. (Hawaiian)). Thus, there were no code-share authorizations available for the America West/Mesa code-share proposal here. Subsequently, Hawaiian filed a dormancy notice for the Los Angeles-Puerto Vallarta market, and we withdrew Hawaiian’s code-share authorization. As a result, both the requisite designation and code-share authorizations were available to allow us to proceed with the instant application.

Re: Partial Cancellation of Codesharing

On November 4, 2005, the Department authorized US Airways, Inc. to code-share on flights operated by America West Airlines, Inc. and Mesa Airlines, Inc. between various points in the United States and Mexico. (See Erratum, Docket OST-2005-22645). On September 26, 2007, America West and US Airways combined their operations under US Airways' Operating Certificate, and all international air service is now being conducted pursuant to certificate and exemption authority previously granted to US Airways.

Accordingly, US Airways hereby requests that the Department cancel its exemption authority to codeshare on flights previously operated by America West in the markets listed:

US Airways intends to continue to place its code on Mesa-operated flights in these markets, as evidenced by its renewal application. (See Application of US Airways for Renewal of Exemptions, September 6, 2007, Docket OST-2005-22645).
