Application for an Exemption

Hereby applies for a two-year exemption from 49 U.S.C. § 41101 and any other provision of the Department's rules, authorizing Mesa to engage in scheduled foreign air transportation of persons, property, and mail between Los Angeles, California and Puerto Vallarta, Mexico, pursuant to a codeshare arrangement with America West Airlines, Inc. under which Mesa's flights in this market will carry America West's two letter designator code. Mesa requests that its exemption be issued as soon as possible so that Mesa can obtain the necessary approvals from the Government of Mexico and begin offering new service.

Scheduled foreign air transportation of persons, property, and mail between Los Angeles, California, and Puerto Vallarta, Mexico.

Mesa states that, as part of this service, it will place the “HP” code of America West on Mesa’s flights in the subject market. Under the U.S.-Mexico aviation agreement, up to two U.S. carriers may be designated to operate direct-carrier service (ownaircraft flights), and up to four U.S. carriers may be authorized to provide code-share services in a given city-pair market. At the time this application was filed, Alaska Airlines, Inc., held one of the designations to serve the Los Angeles-Puerto Vallarta route, and the second designation was available. However, four carriers already held the Los Angeles-Puerto Vallarta code-share authorizations (Continental Airlines, Inc.; Delta Air Lines, Inc.; Northwest Airlines, Inc.; and Hawaiian Airlines, Inc. (Hawaiian)). Thus, there were no code-share authorizations available for the Mesa/America West code-share proposal here. Subsequently, Hawaiian filed a dormancy notice for the Los Angeles-Puerto Vallarta market, and we withdrew Hawaiian’s code-share authorization. As a result, both the requisite designation and code-share authorizations were available to allow us to proceed with the instant application.

Joint Application for Renewal of an Exemption and Code Share Authorization

America West Airlines, Inc. d/b/a US Airways and Mesa Airlines, Inc. apply for a two-year renewal of their exemption and code share authorization to engage in scheduled foreign air transport of persons, property, and mail between Los Angeles, California and Puerto Vallarta, Mexico. Mesa has provided continuous service on these routes, using its CRJ-900 aircraft, since 2004, with America West placing its designation code on these flights. See Notice of Action Taken, Docket No. OST-2003-16718.

Scheduled foreign air transportation of persons, property, and mail between Los Angeles, California, and Puerto Vallarta, Mexico.  The joint applicants state that the authority will be used by placing either the America West “HP*” code and/or the US Airways “US*” code on Mesa Airlines’ flights in the Los Angeles-Puerto Vallarta market.

On September 27, 2005, America West Holdings Corporation merged with US Airways Group, Inc.  As a result, America West became a subsidiary of US Airways Group and is beginning operations under the “US Airways” brand name.  The joint applicants state that America West will advertise, sell tickets, and market the subject services under the “US Airways” brand name, and may use either or both the America West “HP*” or US Airways “US*” code on these flights.

Application for Renewal of Exemption Authority

Mesa Airlines, Inc. hereby applies for renewal of Mesa's exemption authority to engage in scheduled foreign air transportation of persons, property, and mail between Los Angeles, California and Puerto Vallarta, Mexico.

Mesa currently provides scheduled air service in the LAX-PVR market using CRJ regional jet aircraft. US Airways' "US*" code appears on these flights pursuant to the code-share agreement.

US Airways separately received exemption authority to codeshare on Mesa-operated flights between LAX and PVR. (See Notice of Action Taken, November 1, 2007, Docket OST-2005-22645).

Re: Will Not Renew Various US-Mexico Routes

US Airways and Mesa hereby advise the Department that they will no longer provide scheduled air service between the markets listed in Attachment 1 effective August 31, 2008. Accordingly, US Airways and Mesa respectfully provide notice of dormancy with respect to these routes.
