Application for an Exemption

Hereby applies for an exemption and such other statutory and regulatory authority as may be necessary to enable it to engage in scheduled air transportation of property and mail between Colombia, on the one
hand, and the United States, on the other, via Lima, Peru, in both directions. TAMPA requests that this exemption authority be granted for a period of at least one year.

TAMPA has been authorized by the Government of Colombia to operate these flights. TAMPA has been serving the Lima market for several years and has strong commercial and economic ties with Peruvian shippers. The authority requested herein is necessary to effectively serve shippers in this market and will complement TAMPA’s existing all-cargo service to the United States.

The majority of TAMPA’s scheduled and charter flights in recent years have been third and fourth freedom flights between the United States and Colombia, with few fifth freedom operations. TAMPA’s primary focus remains the Colombia – United States market. The addition of Lima as an intermediate point will strengthen TAMPA’s overall Colombia –United States operations and enable it to better compete with other carriers serving these highly competitive markets.

Answer of Atlas Air

Atlas has no objection to grant of the application in full - so long as the United States first obtains assurances that the Government of Colombia has withdrawn its "no triangulation" policy, which in the past has restricted the ability of U.S. carriers like Atlas to operate intermediate and beyond services, and either has granted or stated its intention to grant Atlas' pending application for authority to operate Miami-Quito-Bogota-Miami triangular routings. Until Colombia takes such action, TAMPA will retain an unfair commercial advantage in the U.S.-South America market and certainly should not obtain valuable new U.S. rights.

Requests that the Department refrain from granting the pending TAMPA application in full until Colombia has granted Atlas' pending application for Quito/Bogota triangulation rights or the United States has obtained assurances from the Government of Colombia that Colombia's triangulation prohibition is no longer in effect and the Atlas application will be granted in short order.

Opposition of Arrow to Application

Respectfully states its opposition to the grant of the above referenced application filed by Transportes Aereos Mercantiles Panamencanos, S.A. Arrow Air is opposed because Colombian authorities have consistently denied Arrow Air the opportunity to operate between Quito, Ecuador and Miami, FL via Bogota, Colombia and to carry cargo from Bogota to Miami, in a manner that is inconsistent with the laws of Colombia and with the Air Transport Services Agreement currently in effect between the two countries. The Colombian Government's policy limits Bogota to a technical stop when flights operate beyond Colombia to other points in the Western Hemisphere. Arrow is thus being denied its Third/Fourth Freedom rights between Bogota and Miami, as well as Fifth Freedom opportunities.
