Joint Application for Statements of Authorization and Exemption

US Airways requests a statement of authorization to display Spanair's "JK" designator code on US Airways' flights 1) between Philadelphia and Madrid and 2) between Philadelphia and the following points in the United States: Atlanta, Boston, Baltimore, Washington, D.C. (Reagan National), Denver, Dallas/Ft. Worth, Houston, Las Vegas, Los Angeles, New York (LGA), Orlando, Miami, Minneapolis, New Orleans, Chicago, Phoenix, Pittsburgh, San Diego, Seattle, San Francisco and San Juan. The specific routes that are covered by this code-sharing arrangement are also identified in Appendix A to this Application. Spanair's service beyond Philadelphia would be offered on a blind-sector basis with no local traffic carried under Spanair's code between U.S. points.

Spanair requests a statement of authorization to display US Airways' "US" designator code on Spanair's flights between Madrid and the following points in Spain: Barcelona, Malaga, and Palma de Mallorca. The specific routes that are covered by this code-sharing arrangement are also identified in Appendix A to this Application. US Airways' service would be offered on a blind-sector basis with no local traffic carried under US Airways' code between points in Spain.

(Reagan National), Denver, Dallas/Ft. Worth, Houston, Las Vegas, Los Angeles, New York (LGA), Orlando, Miami, Minneapolis, New Orleans, Chicago, Phoenix, Pittsburgh, San Diego, Seattle, San Francisco and San Juan, on the other hand.

US Airways' request includes its affiliated carriers, Allegheny Airlines, Inc., MidAtlantic Airways, Piedmont Airlines, Inc. and PSA Airlines.

On November 17, 2003, we contemporaneously approved a related request by Aerolineas de Baleares, S.A. (AeBal), a foreign air carrier of Spain, for an exemption and statement of authorization to the extent necessary to permit AeBal to wet lease aircraft to Spanair, for use by Spanair on Spanair flights between Madrid, Spain, on the one hand, and Barcelona, Malaga, and Palma de Mallorca, Spain, on the other hand (limited to the carriage of US Airways' and Spanair's U.S.-Spain traffic). In exchange, US Airways places its US code on Spanair flights between Madrid and Barcelona, on the one hand, and Malaga, Palma de Mallorca and Barcelona, on the other, for carriage within Spain of US Airways' U.S.-Spain transatlantic passengers. Spanair does not operate its own aircraft to any U.S. point. All Spanair U.S. services under the exemption authority are held out pursuant to the codeshare arrangement with US Airways.

Hereby requests renewal of its exemption from 49 U.S.C. § 41301 and from any other provisions of Title 49 and the Economic Regulations of the Department of Transportation to the extent necessary to continue to engage in code-share operations with US Airways, Inc. in certain U.S.-Spain (Madrid/Barcelona) markets.

Spanair places its JK* code on US Airways' Philadelphia‑Madrid and Philadelphia‑Barcelona transatlantic flights, and on US Airways' flights beyond Philadelphia to 21 U.S. points. In exchange, US Airways places its US* code on Spanair flights between Madrid and Barcelona, on the one hand, and Malaga, Palma de Mallorca and Barcelona, on the other, for carriage within Spain of US Airways' U.S.‑Spain transatlantic passengers.
