Joint Application for a Statement of Authorization

(1) the display of Air Jamaica's "JM" designator code on flights operated by Delta between (a) any point or points in the United States and any point or points in Jamaica (either nonstop or via intermediate points), (b) any points in the United States in conjunction with foreign air transportation services held out by Air Jamaica, and (c) any point or points in the United States or Jamaica and any point or points in any third country; and

(2) the display of Delta's "DL" designator code on flights operated by Air Jamaica between (a) any point or points in the United States and any point or points in Jamaica (either nonstop or via intermediate points), (b) any points in Jamaica, (c) any point or points in Jamaica or the United States

The Joint Applicants currently engage in a number of reciprocal codeshare services pursuant to statements of authorization granted in Dockets OST-97-3051, OST-1999-5749, OST-2000-7478, OST-2000-8078 and OST-2000-8394. On October 20, 2002, the United States and Jamaica reached agreement concerning open skies, which will significantly enhance the opportunities for codesharing. Pursuant to that understanding, the Joint Applicants seek to consolidate their existing codesharing authority into a blanket statement of authorization, which will also enable the carriers to add additional codeshare services subject to the Department's standard advance notice requirement. The Joint Applicants request that the blanket statement of authorization remain in effect for an indefinite term, subject to the Department's usual conditions.

Joint Application for an Exemption and Notice of Additional Codesharing

Desiring to further expand the scope of their extensive codeshare operations among points in the United States, Jamaica, and several other Caribbean countries, Delta Air Lines, Inc. and Air Jamaica Limited hereby apply for an exemption, pursuant to 49 U.S.C. 40109(c), that will authorize Air Jamaica to engage in the scheduled foreign air transportation of persons, property, and mail between Atlanta, Georgia and St. Lucia, on a codeshare basis with Delta. Delta and Air Jamaica request that the Department make this exemption effective for a period of two years, and that the Department grant this application expeditiously, as the carriers would like to begin marketing the new codeshare services as far in advance of the Summer vacation season as possible.

Pursuant to their blanket statement of authorization approved March 8, 2004 (Docket OST-2003-16071), the carriers hereby notify the Department that Delta will be carrying the "JM" code on the aforementioned route. In addition, and out of an abundance of caution with respect to their blanket notice condition, Delta and Air Jamaica wish to notify the Department of increased "DL" codeshare activity on flights operated by Air Jamaica between Kingston and Montego Bay. In the past, these intra-Jamaica flights have involved service from various U.S. points where Montego Bay and Kingston were specifically named as co-terminal points. Now that the carriers are operating under the broader authority of a blanket codeshare authorization, Delta and Air Jamaica anticipate adding more behind-gateway intra-Jamaica flights on this route from U.S. gateways where Montego Bay and Kingston were not previously identified as coterminal points.

Re: Result of Poll

Delta Air Lines, Inc. and Air Jamaica Limited have finished polling the relevant U.S. air carriers regarding the Joint Application of Delta Air Lines, Inc. and Air Jamaica Limited for an Exemption and Notice of Additional Codesharing, filed on April 2, 2004 in the above captioned dockets. All of the U.S. air carriers indicated that they have no objection to this application. Accordingly, Delta and Air Jamaica request that the Department expeditiously grant Air Jamaica the exemption authority requested in the application.

Notice Regarding Discontinued Codesharing

Hereby notify the Department that Air Jamaica has suspended service and will no longer display Delta's designator code on flights between Montego Bay, Jamaica and each of the following points: Houston, TX (lAB); Antigua (ANU); Curacao, Netherlands Antilles (CUR) ; and St. Lucia (UVF).

Notice of Additional Codesharing

Pursuant to the blanket statement of authorization approved by the Department on March 8, 2004, Delta Air Lines, Inc. and Air Jamaica Limited hereby notify the Department that, beginning on or about October 15, 2005, the carriers plan to display Air Jamaica's designator code on flights operated by Delta between Cincinnati, Ohio and Montego Bay, Jamaica.

Termination of Codesharing Agreements

Pursuant to condition (b) of the blanket statement of authorization granted to Air Jamaica Limited and Delta Air Lines, Inc. on March 8, 2004 in Docket OST-2003-16071, Air Jamaica and Delta notice the Department that the carriers have agreed to terminate their Codesharing Agreements effective May 1, 2007, and all codesharing activities approved under the blanket statement of authorization will cease on that date.
