Application for an Exemption

America West plans to initiate service to Costa Rica on or about December 1, 2003, with a daily roundtrip between Phoenix, Arizona and San Jose, Costa Rica. America West respectfully requests the Department issue a notification to the Government of Costa Rica designating America West as an airline authorized to conduct international air transportation in accordance with the Bilateral. Plans to commence combination service between PHX and SJO on or about December 1, 2003, operating a daily roundtrip flight using Airbus 319 or similar aircraft.

Application for Renewal of Exemption Authority

Respectfully requests the Department issue an order granting renewal of America West's exemption from 49 U.S.C. § 41101 and any other statute or Economic Regulation of the Department to the extent necessary, to permit it to continue to engage in scheduled foreign air transportation of persons, property and mail from a point or points in the United States via intermediate points to a point or points in Costa Rica and beyond.

Cancellation of Exemption Authority

On September 26, 2007, America West Airlines, Inc. and US Airways, Inc. combined their operations under US Airways' Operating Certificate. As a result of this operational consolidation, domestic and international air service for both companies is now being conducted pursuant to certificate and exemption authority previously granted to US Airways.

Accordingly, America West hereby requests that the Department cancel its Certificate of Public Convenience and Necessity for Interstate Air Transportation, issued on July 8, 1998, by Order 1998-7-6. America West further requests that the Department cancel the certificate and exemption authority for international service held by America West.
