Application for an Exemption

North American proposes to initiate service with one weekly roundtrip using Boeing 767-300ER and increase to two weekly roundtrips on or about September 9, 2003. The initial service would operate Wednesday or Thursday as follows:

Depart BWI 0940, arrive Bucharest* (BUH) 0250, depart BUH 0335, arrive BGW 0800, depart BGW 1000, arrive BUH* 1240, depart BUH 1440, arrive BWI 1820.

Answer of the State of Maryland

North American's Application is consistent with the public interest and should be approved for several reasons. First, North American already has experience operating to the Middle East. The carrier provides passenger service to the Military Airlift Command, including flights to Kuwait, and regularly operates charters to the Middle East region, as well as Europe, Asia and Latin America. Second, North American also has experience performing program and ad hoc public and single-entity charters worldwide for various airlines. Third, approval of North American's Application would bring important new transatlantic service to BWI. BWI's direct scheduled transatlantic service is limited to London, England; Shannon/Dublin, Ireland; and Reykjavik, Iceland. Lastly, North American's proposed service would benefit passengers, especially U.S. Government and military officials in the greater Baltimore-Washington, D.C. region, traveling to Baghdad to assist in the U.S.-led Iraqi reconstruction effort. BWI is uniquely situated to help facilitate this effort, given that it is the East Coast collection point for overseas military flights operated through the Air Mobility Command.

Notice granting the applications of Air Transport International, LLC.; Gemini Air Cargo, Inc.; Evergreen International Airlines, Inc.; Atlas Air, Inc.; Polar Air Cargo, Inc.; North American Airlines, Inc.; and, Continental Airlines, Inc., subject to conditions. Effective July 29, 2003 through July 29, 2005. Petitions due August 7, 2003.

We remind all of the carriers seeking to exercise Iraq authority (whether underlying route authority or code-share authority) that the authority granted here cannot alone result in new service to Iraq. (See Order 2003-6-20.) This authority is subject to compliance with all applicable Office of the Coalition Provisional Authority, Department of Transportation, Federal Aviation Administration, Transportation Security Administration, Department of Defense, and other U.S. Government requirements. Further, to assure compliance with all applicable U.S. Government requirements concerning security, before commencing any new service (including charter flights) to or from a foreign airport, carriers are reminded to contact their Principal Security Inspector (PSI) to advise the PSI of their plans and to find out whether the Transportation Security Administration has determined that security is adequate to allow such airport(s) to be served.

Consistent with Order 2003-6-20, we deferred on applications to the extent that they sought authority to serve Afghanistan. We will process Afghanistan requests separately.

Application for Renewal of an Exemption

North American and all other U.S. carriers authorized to provide scheduled commercial service to Iraq have not done so due to the continuing conflict in the country. As a result, initiation of scheduled commercial combination service is not yet viable from a security or economic standpoint.
