Lufthansa CityLine GmbH OST-2003-15485 - Exemption and Statement of Authorization - Part 212 Codeshare Operations with United Air Lines June 20, 2003 Application for Exemption and Statement of Authorization Lufthansa CityLine's code-share services for United are governed by the existing United/Lufthansa code-share agreement previously submitted to the Department. For the administrative convenience of the Department and the carriers and to allow routine schedule changes as may be necessary between mainline and connection carrier equipment, notice of specific code-share routes given to the Department by either Lufthansa or Lufthansa CityLine should be deemed notice given for each of the carriers. Lufthansa CityLine requests: 1) a statement of authorization permitting Lufthansa CityLine to display United's two-letter "UA" code on flights operated by Lufthansa CityLine between points in Germany, and between points in Germany and points in third countries; and (ii) an exemption permitting Lufthansa CityLine to transport persons, property and mail under the designator code of United between points in Germany, and between points in Germany and points in third countries. Lufthansa CityLine, a German-certificated air carrier, is wholly owned and controlled by Lufthansa AG. Pursuant to a marketing and franchise agreement, Lufthansa CityLine operates services exclusively on behalf of Lufthansa under the Lufthansa brand. As part of this arrangement, Lufthansa CityLine operates flights with its own aircraft and crews between points in Germany, and between points in Germany and points in third countries. In 2002, Lufthansa CityLine carried more than 6.2 million passengers on up to 500 scheduled flights per day to 61 destinations in Europe. As one of Europe's leading regional airlines, Lufthansa CityLine provides a high standard of service to meet the growing demand for non-stop connections between Europe's major cities and regions. The carrier provides feeder services to Lufthansa and other Star Alliance member carriers, particularly at Lufthansa's Frankfurt and Munich hubs, improving the quality of the Star Alliance network and integrating European regions into that global network. October 30, 2003 Re: Codeshare Notice (Munich-Kiev) Pursuant to Notice of Action Taken, dated July 15, 2003, in Docket OST-03- 15485, United hereby gives notice on behalf of itself and Lufthansa CityLine of their intention to commence code-share service between Munich, Germany, and Kiev, Ukraine. Lufthansa CityLine will display United's designator on flights operated by Lufthansa CityLine in that city pair. As explained in the attached Application, services will begin on the later of November 29, 2003, or the date when all necessary approvals (including those requested in the attached application) have been received. In addition, United does not sell seats in its own name on Lufthansa CityLine's flights for travel in local Germany‑third country and intra‑Germany markets. To the extent necessary, United, Lufthansa, Lufthansa CityLine and Air Dolomiti request a waiver of the 30-day notice requirement. The code-share flights to Pisa are replacement flights for services currently being operated to Florence. The carriers have been advised by the Italian authorities that, effective February 2, 2006, flights to the Florence airport will be temporarily rerouted to Pisa due to runway construction at Florence. The proposed code-share services are consistent with the bilateral air transport agreements between the United States and Germany and Italy. United. Lufthansa and Air Dolomiti have previously given notice to the Department of code-share services between Munich and Pisa, but are jointly giving this notice as these routes may now also be operated by Lufthansa CityLine on Lufthansa's behalf.
