Application for an Exemption

Applies for an exemption from 49 U.S.C. § 41101 authorizing Continental to provide scheduled foreign air transportation of persons, property and mail between any point or points in the U.S., directly or via any intermediate point or points, and any point or points in Iraq and beyond and to combine the authority requested with authority at other points Continental is authorized to serve by certificate or exemption. Continental plans to use its new authority initially pursuant to its codeshare agreement with KLM as soon as KLM secures all necessary government approvals to institute Amsterdam-Baghdad service, but Continental seeks broad authority to operate its own flights serving Iraq and other points as well as offering codeshare service. Continental asks that authority for an indefinite period be awarded promptly to facilitate marketing and advance sales of its new codeshare services.

Notice of Action Taken | Word

Notice granting the applications of Air Transport International, LLC.; Gemini Air Cargo, Inc.; Evergreen International Airlines, Inc.; Atlas Air, Inc.; Polar Air Cargo, Inc.; North American Airlines, Inc.; and, Continental Airlines, Inc., subject to conditions. Effective July 29, 2003 through July 29, 2005. Petitions due August 7, 2003.

We remind all of the carriers seeking to exercise Iraq authority (whether underlying route authority or code-share authority) that the authority granted here cannot alone result in new service to Iraq. (See Order 2003-6-20.) This authority is subject to compliance with all applicable Office of the Coalition Provisional Authority, Department of Transportation, Federal Aviation Administration, Transportation Security Administration, Department of Defense, and other U.S. Government requirements. Further, to assure compliance with all applicable U.S. Government requirements concerning security, before commencing any new service (including charter flights) to or from a foreign airport, carriers are reminded to contact their Principal Security Inspector (PSI) to advise the PSI of their plans and to find out whether the Transportation Security Administration has determined that security is adequate to allow such airport(s) to be served.

Consistent with Order 2003-6-20, we deferred on applications to the extent that they sought authority to serve Afghanistan. We will process Afghanistan requests separately.

Application for Renewal

Continental plans to use its Iraq authority pursuant to its codeshare agreement with KLM as soon as all necessary government approvals are secured, and Continental seeks renewal of its broad authority to operate its own flights serving Iraq and other points as well as offering codeshare service. Renewing Continental's Iraq authority will serve the public interest since it will give Continental broad flexibility to provide additional services that will enhance international competition and increase the service options available for passengers and shippers between the U.S. and Iraq and at other points. The same public interest benefits supporting the Department's grant of exemption authority to other carriers for U.S.‑Iraq services justify the Department's renewal of Continental's Iraq authority.

Continental and KLM hold blanket codeshare authority, and Continental has submitted a notice in Docket OST-01-10880 regarding the proposed Baghdad service
