Application for an Exemption | Word

Frontier Airlines, Inc., pursuant to 49 U.S.C. 40109, hereby applies for a two-year exemption from 49 U.S.C. 41101 and any other provision of the Department's rules to the extent necessary to engage in scheduled foreign air transportation of persons, property, and mail between Denver, Colorado, and Puerto Vallarta, Mexico with services beginning on November 22, 2003.

Frontier is fit, willing, and able to perform the U.S.-Mexico services proposed herein using Airbus A-319-111 aircraft, with an average seat configuration of 132 seats, and Boeing 737-300 aircraft, with an average seat configuration of 136 seats. Frontier reserves the right to serve this route with other aircraft from its fleet.

Hereby applies for a renewal of its existing exemption authority from 49 U.S.C. 41101 and any other provision of the Department of Transportation's rules to the extent necessary to continue to engage in scheduled foreign air transportation of persons, property, and mail between Denver, Colorado (DEN) and Puerto Vallarta, Mexico (PVR).

Application for Renewals of Exemption Authorities

Frontier hereby applies for a renewals of its existing exemption authorities to continue scheduled foreign air transportation of persons, property, and mail between Denver, Colorado and Puerto Vallarta, Mexico and DEN and Ixtapa/Zihuatanejo, Mexico.

Frontier requests that its exemption authorities to operate these services be extended two years in accordance with Departmental policy. Frontier requests that these exemptions be given a June 6, 2009 expiration date, so that they will share a common expiration date with those exemptions granted to Frontier June 6, 2007. See Notice of Action Taken issued June 6, 2007 in Dockets OST-2005-21033, OST-2002-13061, OST-2002-13011, OST-2004-17466, OST-2004-17467, OST-2004-18179. The establishment of a common renewal date will promote administrative efficiency and reduce the burden on Frontier and the Department in maintaining these non-controversial U.S.-Mexico exemption
authorities.

Frontier is fit, willing, and able to perform the DEN-PVR, and DEN-ZIH service it proposes to renew herein using Airbus A-319-111 aircraft, with an average seat configuration of 132 seats. Frontier reserves the right to serve these routes with other aircraft from its fleet.

Re: Polling Results

On June 29, 2007, Frontier Airlines applied for renewal of its existing exemption authorities to continue scheduled foreign air transportation of persons, property, and mail between Denver, Colorado and Puerto Vallarta, Mexico and between Denver, Colorado and Ixtapa/Zihuatanejo, Mexico.

No objections have been filed in either docket since Frontier's June 29th applications for renewal. Frontier therefore requests that the Department grant the renewal of exemption authorities as soon as possible.
