Application for an Exemption

Hereby applies for an exemption and, to the extent necessary, a designation in order to engage in scheduled foreign air transportation of persons, property and mail between Washington, D.C., San Francisco, Chicago, and Los Angeles, on the one hand, and Mexico City, Mexico, on the other hand. To the extent warranted, US Airways also seeks integration authority to combine this exemption authority with US Airways' other authorities. US Airways plans to serve Mexico City from these four U.S. gateways pursuant to its code-share agreement with United Air Lines.

Application for Renewal of an Exemption

By Notice of Action Taken, July 23, 2003, the Department granted US Airways exemption authority in this Docket in order to operate scheduled service between the co‑terminal points of Washington, D.C., San Francisco, Chicago, and Los Angeles, on the one hand, and the terminal point Mexico City, Mexico, on the other hand, as well as related route integration authority ‑ services which it planned to offer pursuant to its codeshare arrangement with United Airlines. By letter dated February 3, 2005, US Airways informed the Department that it was no longer codesharing with United on the SFO‑MEX and LAX‑MEX routes.

US Airways herein seeks to renew its Washington, D.C./Chicago‑Mexico City exemption authority. Renewal of US Airways' exemption will serve the public interest by permitting US Airways to provide competition to other carriers serving Mexico City directly and through codeshare services. US Airways is currently offering nonstop codeshare services on these routes with its partner United Airlines.

Notice of Action Taken

Scheduled foreign air transportation of persons, property, and mail between the co‑terminal points of Washington, D.C., and Chicago, Illinois, on the one hand, and the terminal point Mexico City, Mexico, on the other hand'; along with route integration authority to combine this exemption with US Airways' existing exemption and certificate authority. US Airways proposes to continue to conduct these services pursuant to its code‑share arrangement with United Air Lines, Inc. (United), whereby US Airways will place its designator code on flights operated by United in these markets.

Previously, in this docket, US Airways was also granted exemption authority to serve the Los Angeles/San Francisco‑Mexico City markets (see Notice of Action Taken dated July 23, 2003). However, by letter dated February 3, 2005, US Airways informed the Department that it was no longer code‑sharing on flights operated by United between San Francisco and Los Angeles, on the one hand, and Mexico City, on the other hand. Thus, US Airways does not seek to renew the Los Angeles/San Francisco‑Mexico City authorities here.

US Airways currently provides scheduled air service between the coterminal points of Washington, D.C., and Chicago, Illinois, on the one hand, and the terminal point Mexico City, Mexico, on the other hand, pursuant to a code-share relationship with United Airlines.
