Hereby applies for an exemption under 49 U.S.C. §40109 permitting United to hold out scheduled combination service of persons, property and mail between Boston, MA, Charlotte, NC, Pittsburgh, PA, and Philadelphia, PA, on the one hand, and Cancun, Mexico, on the other, and between Charlotte, NC and Cozumel, Mexico, under a code share with US Airways, Inc. United requests that its exemption be granted for a two-year period. United plans to open for sale on these routes on March 23, 2003, for services to begin on April 3, 2003.

Exemption for two years under 49 U.S.C. 40109 to provide the following service: Scheduled foreign air transportation of persons, property, and mail between (1) the terminal point Boston, Massachusetts, and the terminal point Cancun, Mexico; (2) the terminal point Charlotte, North Carolina, and the terminal point Cancun, Mexico; (3) the terminal point Pittsburgh, Pennsylvania, and the terminal point Cancun, Mexico; (4) the terminal point Philadelphia, Pennsylvania, and the terminal point Cancun, Mexico; (5) the terminal point Charlotte, North Carolina, and the terminal point Cozumel, Mexico; (6) the terminal point Charlotte, North Carolina, and the terminal point Mexico City, Mexico; and (7) the terminal point Philadelphia, Pennsylvania, and the terminal point Mexico City, Mexico. United proposes to use the requested authority to provide code sharing services on US Airways' flights. United proposes to begin services in the U.S: Cancun/Cozumel markets beginning April 3, 2003, and the U.S: Mexico City markets beginning October 1, 2003.

Hereby informs the Department that United does not plan to commence Philadelphia-Mexico City code-share service by April 1, 2004. United further notifies the Department pursuant to Notice of Action Taken, dated March 20, 2003, in Docket OST-03-14576 that United's Philadelphia-Mexico City exemption authority will be dormant effective April 1, 2004, when the blanket waiver of Order 03-4-18 expires.
To the extent necessary, United requests leave to file the notice required by Order 03‑4‑18 two days late. The late filing is due to the need to coordinate between United and its code‑share partner for Philadelphia‑Mexico City service, USAirways, Inc. The late filing is in these circumstances due to excusable neglect and will not prejudice any party.

United requests an amendment to its current certificate for Route 566 to include the following additional U.S.-Mexico route segments for which it received exemption authority since the issuance of its certificate, and, hereby requests renewal of this exemption authority by substantially equivalent certificate authority pursuant to 14 C.F.R. § 377.10(c)(4):

United's exemption authority was issued for a two year period and is currently set to expire March 20, 2005, in Docket OST-03-14576, and September 25, 2005, in Docket OST-03-16073. United hereby invokes the automatic extension provisions of the Administrative Procedure Act, 5 U.S.C. §558(c), as implemented by 14 C.F.R. Part 377, to continue its exemption authorities in effect pending final Department action on this application, which is timely filed under 14 C.F.R. § 377. 10(c)(4).

Withdrawal of Renewal Requests
United Air Lines, Inc. hereby notifies the Department that the request for renewal of its exemption authority set forth in its Supplement to Application of United for Renewal and Amendment of a Certificate of Public Convenience and Necessity filed December 10, 2004, in the above-referenced dockets is withdrawn with respect to the following U.S.-Mexico city-pair markets as its code-share services with US Airways on these routes are dormant:

United continues to code share on the Charlotte-Mexico City and Charlotte-Cozumel routes with US Airways. Accordingly, United's request for renewal of its exemption authority for these two routes set forth in the supplement referenced above remains pending in Docket OST-2003-14576.
