Hereby applies for an exemption from49 U.S.C. § 41301 to the extent necessary to permit SN Brussels to provide scheduled foreign air transportation of persons, property and mail between a point or points behind Belgium, via Belgium and intermediate points, to a point or points in the United States and beyond. Specifically, SN Brussels will enter into a codeshare agreement with American Airlines whereby SN will operate to points beyond Brussels in Europe and Africa and American will operate transatlantic routes and domestic routes within the U.S.

SN Brussels currently does not plan to operate to the U.S. directly using its own aircraft. SN Brussels will operate all routes between Brussels and Africa under a wet lease agreement with Birdy Airlines, a Belgian career.

Exemption from 49 U.S.C. 41301 to conduct scheduled foreign air transportation of persons, property and mail between points behind Belgium, via Belgium and intermediate points, to points in the United States, and beyond; and charters pursuant to 14 CFR 212 of the Department's regulations.

SN Brussels proposes initially to conduct code-share operations for American Airlines between Brussels and Africa using aircraft wet leased from Birdy Airlines, a Belgian carrier. (By separate action on March , 2003, we approved the joint application of SN Brussels and American for code-share authority in Docket OST-2003-14629, and granted Birdy authority to conduct wet lease operations for SN Brussels between Brussels and Africa in Docket OST-2003-14571.)

Application for Renewal of Exemption Authority

Delta Air Transport N.V., d/b/a SN Brussels Airlines, in accordance with the provisions of Section 416 of the Federal Aviation Act of 1958, as amended, 49 U.S.C. § 40109(c), and Subpart C of the Department’s Rules of Practice, 14 C.F.R. § 302.301 et seq, hereby requests renewal of its exemption from 49 U.S.C. § 41301 to conduct scheduled foreign air transportation of persons, property and mail between a point or points behind Belgium, via Belgium and intermediate points, to a point or points in the United States. SN seeks this authority so that it may continue its codeshare operations with American Airlines, whereby SN Brussels operates to points beyond Brussels in Europe and Africa and American operates transatlantic routes and domestic routes within the U.S. See Docket OST-2003-14629. SN Brussels currently does not operate to the U.S. directly using its own aircraft.

Re: Amendment to Exemption Authority to Include US-Beyond Points

Delta Air Transport N.V. d/b/a SN Brussels Airlines was issued exemption authority on April 11, 2003 in the above-mentioned docket to provide scheduled foreign air transportation of persons, property and mail between points in Belgium, via Belgium and intermediate points, to points in the United States, and beyond. The authority was for a period of two years.

On March 28, 2005, SN Brussels filed an Application for Renewal of Exemption Authority to renew the existing authority. In the application, we inadvertently failed to include points beyond the United States. Accordingly, we request that the application be amended to request beyond points and that authority be granted consistent with SN Brussels' current exemption authority.

The applicant states that it currently exercises this authority by codeshare operations with American Airlines, Inc., whereby SN Brussels operates to points beyond Brussels in Europe and Africa carrying the American designator code (AA), and American operates transatlantic and beyond-gateway intra-U.S. flights carrying the SN Brussels designator code (SN).  SN Brussels does not currently operate directly to the U.S. using its own aircraft.

Application for Registration of Trade Name Change

DAT respectfully requests that the United States Department of Transportation approve and register a change in the trade name of DAT. As the name change will take effect on March 27, 2007, DAT hereby requests that the Department grant this application expedited consideration prior to this date.

  1. SN Brussels Airlines is the trade name of DAT.
  2. On March 27, 2007, DAT will no longer conduct its operations under the trade name SN Brussels Airlines, but will be doing business under the trade name Brussels Airlines.
  3. DAT's Belgian Air Operator Certificate will remain in the name of DAT.
  4. The change is one in DAT's trade name only, and does not comprise a substantial change in ownership since this change will not affect DAT's operations, ownership or management.
  5. The trade name Brussels Airlines is not identical or similar to the name of any other certificated, commuter or foreign air carrier.

Re: Acknowledgment of Registration of Trade Name

By application filed March 21,2007, in Dockets OST-2003-14336 and OST-2003-14337, Delta Air Transport N. V., a foreign air carrier of Belgium, requested to register a change in trade name from "SN Brussels Airlines" to "Brussels Airlines" under 14 CFR Part 215 of our regulations.

Pursuant to Part 215, we compared the proposed name with our list of names used by existing certificated, commuter, and foreign air carriers and with those applicants seeking new authority. We have completed our review and determined that no similarly named carrier(s) need be served.

This letter acknowledges the registration of the name "Brussels Airlines" under 14 CFR Part 215 and shall constitute the notice thereof under section 215.6 of our regulations.

Brussels Airlines seeks this authority so that it may continue its codeshare operations with American Airlines, whereby Brussels Airlines operates to points beyond Brussels in Europe and Africa and American operates transatlantic routes and domestic routes within the U.S. See Docket OST-2003-14629. Brussels Airlines currently does not operate to the U.S. directly using its own aircraft.

Brussels Airlines currently provides convenient and economical scheduled and charter passenger and cargo transportation throughout Europe and Africa. Its codeshare arrangement with American provides the benefits of competition for travelers and shippers in the United States and Belgium and, accordingly, approval of the requested authority is in the public interest.
