ACES requests underlying exemption authority, for purposes of serving as the non-operating carrier on a codeshare-only basis, to provide service to Atlanta, Boston, Chicago, Dallas/Ft. Worth, Denver, Houston, Los Angeles, Orlando, Philadelphia, Tampa, and Washington, D.C.

AVIANCA requests the same codeshare exemption authority to serve each of the above-named points except Los Angeles (which is already an authorized point in AVIANCA's foreign air carrier permit).

Delta requests a Statement of Authorization to carry the designator codes of ACES and AVIANCA on (i) Delta flights between Atlanta and Bogota, Colombia, and (ii) on Delta flights between ACES's and AVIANCA's authorized U.S. gateways and the following domestic service points: Atlanta, Boston, Chicago, Dallas/Ft. Worth, Denver, Houston, Los Angeles, Orlando, Philadelphia, Tampa, and Washington, D.C.

The initial operating plan is for codesharing via Atlanta to Chicago, Denver, Houston, Los Angeles, Philadelphia, and Washington, D.C. and via Fort Lauderdale to Boston, Dallas/Ft. Worth, Orlando, and Tampa.

Delta has entered into codesharing agreements with ACES and AVIANCA which will enable the carriers to extend the scope of their U.S.-Colombia services by codesharing on Delta's Bogota-Atlanta flights and on Delta's flights to other major U.S. traffic points from Atlanta and Fort Lauderdale, as described above. The agreements also contemplate that Delta will codeshare on flights by ACES and AVIANCA between the U.S. and Colombia and beyond the Colombian gateways to additional points in Colombia. However, the codeshare partners are applying now only for the authorizations necessary for ACES and AVIANCA to place their designator codes on Delta operations. This approach will enable the Department to act expeditiously on those elements of the codesharing agreements that can be processed by the Department without delay and implemented by the parties immediately.

AVIANCA requests an exemption from 49 U.S.C. 41301 to conduct foreign air transportation of persons, property and mail between currently authorized points in Colombia, via currently authorized U.S. gateways, to Atlanta, Boston, Chicago, Dallas/Ft. Worth, Denver, Houston, Orlando, Philadelphia, Tampa and Washington, D.C., on a code-share basis only.

Delta requests a statement of authorization pursuant to 14 CFR 212 of the Department's regulations to display the airline designator codes of ACES and AVIANCA on Delta flights (1) between Atlanta and Bogota; (2) between ACES's and AVIANCA's authorized U.S. gateways and Atlanta, Boston, Chicago, Dallas/Ft. Worth, Denver, Houston, Los Angeles, Orlando, Philadelphia, Tampa and Washington, D.C.

ACES is currently authorized to serve Bogota, Medellin, Cali, Cartagena, Barranquilla in Colombia, and Miami, San Juan and Ft. Lauderdale in the United States (see Order 94-3-28 and Dockets OST-96-1026, OST-2002-11739 and OST-2002-13660).

AVIANCA is currently authorized to serve any point or points in Colombia, and to serve Miami, New York, and San Francisco or Los Angeles (see Order 86-9-36).

Joint Application for Amended Codesharing Exemption Authority and Statements of Authorization

The Joint Applicants now seek the following additional authorities:

(a) a statement of authorization under 14 C.F.R. Part 212 permitting the display of Delta's "DL" designator code on flights operated by ACES between (i) Fort Lauderdale, Florida and Bogota, Colombia, and (ii) Miami, Florida, on the one hand, and Cali, Cartagena de Indias, and Medellin, Colombia, on the other hand;

(b) a statement of authorization under 14 C.F.R. Part 212 permitting the display of Delta's "DL" designator code on flights operated by AVIANCA between (i) Miami, Florida, on the one hand, and Bogota and Barranquilla, Colombia, on the other hand, and (ii) New York, New York, on the one hand, and Bogota and Medellin, Colombia, on the other hand;

(c) a statement of authorization under 14 C.F.R. Part 212 permitting the display of Delta's "DL" designator code on flights operated by ACES and AVIANCA between Bogota, Colombia and the following points in Colombia and Ecuador: (i) Armenia, Barranquilla, Bucaramanga, Cali, Cartagena de Indias, Cucuta, Manizales, Medellin, Pereira, and San Andres Island, Colombia, and (ii) Guayaquil and Quito, Ecuador; and

(d) an exemption under 49 U.S.C. § 40109 authorizing Delta to provide scheduled foreign air transportation of persons, property, and mail between (i) points in the United States and points in Colombia, via intermediate points and beyond, and (ii) points in the United States and Guayaquil and Quito, Ecuador, via intermediate points and beyond; and to combine such exemption authority with all other Delta exemptions and certificates, to the extent permitted by applicable international agreements.

The Joint Applicants plan to implement Delta codeshare services on flights operated by the Allianza Summa carriers as soon as the codeshare safety audit process has been completed and after the Joint Applicants have obtained the necessary authority from each Government.

Delta also has a certificate application pending for the New York-Bogota and Atlanta/New York-Guayaquil/Quito routes in Docket OST-97-3218.

Correspondence of AVIANCA and ACES

The two Colombian carriers, Aeronlineas Centrales de Colombia, S.A. and Aerovias Nacionales de Colombia, S.A., which are jointly owned and controlled, have restructured their operations. ACES, as previously notified to the Department, has suspended all services and AVIANCA will replace ACES on routes to the U.S., including Bogota - Fort Lauderdale, effective on October 16, 2003. The Department has authorized AVIANCA to operate the Bogota - Fort Lauderdale service. (Notice of Action Taken, August 15, 2003, OST 2003-15898.)

The Department also has previously authorized the two Colombian "sister" carriers to codeshare with Delta Air Lines, Inc. on their respective services between Colombia and the U.S. including the authority to carry Delta's code on the Bogota - Fort Lauderdale service operated by ACES. (Notice of Action Taken, August 13, 2003, OST 2003-14057) Due to AVIANCA's replacement of ACES on that route, the parties intend that AVIANCA will carry Delta's code between Bogota and Fort Lauderdale effective October 16, 2003. Accordingly, we request that the Department amend the NOAT to reflect the substitution of AVIANCA for ACES as the carrier carrying Delta's code between Bogota and Fort Lauderdale.

Applies for renewal of exemption authority, pursuant to 49 U. S.C. sections 40109 and 41301, to serve certain points in the United States by code sharing on the operations of Delta Air Lines, Inc. By Notice of Action Taken in this docket on February 3, 2003, the Department authorized Avianca to conduct foreign air transportation, on a codeshare basis only, between currently authorized points in Colombia, via currently authorized U.S. gateways, and Atlanta, Boston, Chicago, Dallas/Ft.Worth, Denver, Houston, Orlando, Philadelphia, Tampa and Washington, D.C. In the NOAT, the Department also granted the same authority, plus Los Angeles, to ACES and granted Delta a Statement of Authorization to carry the codes of Avianca and ACES. ACES is no longer operating and does not seek renewal.

Joint Application for Amended Statements of Authorization and Exemption

The Joint Applicants request that this amendment request be granted as soon as possible, to provide ample time to introduce proposed new codesharing services beginning in February 2004. Initially, the Joint Applicants plan to implement (1) Delta codeshare services on flights operated by AVIANCA over the routing New York-Medellin-Cali, and (2) AVIANCA codeshare services on flights operated by Delta between Ft. Lauderdale and New York (LGA).

Although Delta's code is currently displayed on AVIANCA's nonstop New York-Medellin flights, the existing statement of authorization would not allow Delta's code to be placed on flight segments within Colombia beyond Medellin (or any other gateway except Bogota). Similarly, although AVIANCA's code may be displayed on Delta flights to certain interior U.S. points beyond AVIANCA's U.S. gateways (which include Ft. Lauderdale and New York), the existing statement of authorization and AVIANCA exemption do not include beyond-gateway codeshare service to New York.

By Notice of Action Taken - Docket 2003-14057, August 13, 2003, the Department authorized, inter alia, Aerolineas Centrales de Colombia to carry the code of Delta Air Lines between (1) Fort Lauderdale and Bogota, and (2) Miami and the Colombian coterminal points Cali, Cartegena de Indias, and Medellin. The same Notice authorized Aeronaves Nacionales de Colombia to carry Delta’s code between Miami and the Colombian coterminal points Bogota and Barranquilla. Due to the suspension of all services by ACES, its affiliated carrier, AVIANCA, has replaced ACES operations to the United States, including codeshare services with Delta Air Lines. By Notice issued on October 15, 2003, the Department amended the above-referenced Notice to permit AVIANCA, rather than ACES, to carry Delta’s code between Fort Lauderdale and Bogota.

Department Action on Application

Application of Delta and Avianca for an Amended Statement of Authorization under 14 C.F.R. Part 212 to permit Avianca to display the “DL” code of Delta, on Avianca flights between Los Angeles, California, and Bogota, Colombia.

Delta holds exemption authority to serve between the United States and 11 named points in Colombia, consistent with the US-Colombia Air Transport Agreement, on a code-share only basis with Avianca. Bogota is a named point under that agreement. We also note that Delta holds direct authority to serve the Atlanta-Bogota market. (See Order 2000-9-21). Avianca holds Los Angeles-Bogota operating authority pursuant to its foreign air carrier permit. (See Order 1986-9-36).

Aerovias Nacionales de Colombia, S.A. and Delta Air Lines, Inc. hereby apply for a further amendment to the statement of authorization issued by Notice of Action Taken dated August 13, 2003, as amended by Notice of Action Taken dated February 9, 2005 (Docket OST-2002-14057), to authorize the Joint Applicants to display AVIANCA's designator code on flights operated by Delta between AVIANCA's authorized U.S. gateways and Salt Lake City, substituting Salt Lake City for Tampa as one of the authorized U.S. code sharing points.

On March 14, 2007, AVIANCA filed an application in this Docket for renewal of its exemption authority for U.S.-Colombia codesharing service with Delta. Subsequently, on April 4, 2007, AVIANCA filed an amendment to its renewal application to substitute Salt Lake City for Tampa as an authorized point for codesharing with Delta. By this application, the Joint Applicants are seeking the corresponding amended statement of authorization for Delta to display AVIANCA's code on Delta flights between AVIANCA's authorized U.S. gateways and Salt Lake City, instead of Tampa.

Notice of Suspension of Codesharing

Pursuant to the statements of authorization granted in this Docket, Aerovias Nacionales de Colombia, S.A. and Delta Air Lines, Inc. hereby notify the Department that AVIANCA and Delta will suspend codesharing as of December 29, 2007, for travel effective June 1, 2008. The indefinite suspension is the result of technology interface issues relating to implementation of lATA's E-ticketing standards, which Delta has adopted. The underlying authorities and the codeshare agreement will remain in effect, and therefore, under Condition (a) of the Statements of Authorization, the codeshare authority will remain in effect.

The last day of DL* codeshare operations will be May 31. The last day of AV* codeshare operations is targeted for May 31 as well.

Application for Codesharing Exemption Authority

Avianca S.A. hereby applies for renewal of its exemption authority pursuant to 49 U.S.c. §§ 40109 and 41301, under which it conducts foreign air transportation of persons, property, and mail between the United States and Colombia pursuant to a code-sharing agreement with Delta Air Lines, Inc. Avianca also requests an amendment of this authority. Avianca's exemption authority for these services, most recently granted by Notice of Action Taken on May 10, 2007, expires on May 10, 2008.

Avianca requests that this authority be amended to remove Orlando as a point to which Avianca operates pursuant to its code-share agreement with Delta.

Notice of Action Taken

Renew and amend exemption from 49 U.S.C. § 41301 to conduct foreign air transportation of persons, property and mail between currently authorized points in Colombia, via currently authorized U.S. gateways, to Atlanta, Boston, Chicago, Dallas/Ft. Worth, Denver, Houston, New York, Philadelphia, Salt Lake City, and Washington, D.C, on a code-share basis only, with Delta Air Lines.

On May 10, 2007, we in the present docket, granted AVIANCA exemption authority to conduct foreign air transportation of persons, property and mail between currently authorized points in Colombia, via currently authorized U.S. gateways, to Atlanta, Boston, Chicago, Dallas/Ft. Worth, Denver, Houston, Orlando, New York, Philadelphia, Salt Lake City, and Washington, D.C, on a codeshare basis only, with Delta Air Lines. AVIANCA is now requesting that in renewing its existing authority, we amend the authority to remove Orlando as an authorized code-share point.
