US Airways currently operates nonstop service to Cancun from its gateway hub networks at Charlotte, Pittsburgh, and Philadelphia. US Airways' proposed Boston-Cancun service will complement these services. US Airways plans to operate its Boston-Cancun service year-round on Saturdays commencing on or about March 2003. For this service, US Airways plans to utilize A-319 aircraft.
Although American Airlines has announced that it plans to serve the BostonCancun market, US Airways' request is still within the double-designation-per-city-pair limitation.

US Airways requests that the two exemption authorities described above be renewed with a common expiration date to run concurrently with its other Cancun exemption authority in Docket OST‑200213855, set to expire on December 4, 2004. US Airways also requests that its Cancun exemption authorities be consolidated into one of the referenced dockets.
We have granted the carrier's request to consolidate the exemption authority granted here into Docket OST-2002-13855. Thus, the carrier may henceforth file in Docket OST-2002-13855 at such time as it seeks to make requests concerning its exemption authority to serve the Charlotte/Philadelphia/Pittsburgh-Cancun markets.

Application to Amend an Exemption
Hereby applies to amend its current exemption in this docket so that it may operate scheduled foreign air transportation between Ft. Lauderdale, Florida, and Cancun, Mexico. To the extent necessary, US Airways further requests a designation for such service, with flights beginning on or around July 17, 2004. US Airways plans to operate its service on a year-round basis commencing approximately July 17, 20042. For this service, US Airways plans to utilize Airbus A-319 aircraft, currently in its fleet, with 120-seats configured with 12F and 112Y seats. The initial service plan is for Saturday-only, but as traffic develops, US Airways anticipates adding additional frequencies.
US Airways' PHI/CLT/PIT-Cancun authority was recently renewed and consolidated into Docket OST-02-13855.

US Airways intends to inaugurate nonstop service from Washington Dulles International Airport (lAD) and from Baltimore, MD (BWI) to Cancun, Mexico. This new service will complement existing US Airways service to Mexico (Cancun, Cozumel and Mexico City). In so doing, US Airways will bring the benefits of additional competition, new nonstop service, and additional on-line connecting options for consumers. US Airways plans to operate its services on a year-round basis commencing approximately July 17, 2004. US Airways plans to utilize Airbus A-319 aircraft, currently in its fleet, with 120-seats configured with 12F and 112Y seats.
United Air Lines is the only U.S. carrier currently providing scheduled, nonstop service in the Washington, D.C.-Cancun market. USA 3000 is the only U.S. carrier currently providing scheduled, nonstop service in the Baltimore-Cancun market

By Notice of Action Taken, December 4, 2002, the Department granted US Airways authority in this Docket to operate scheduled service between Boston and Cancun. By NOAT, January 30, 2004, the Department renewed US Airways' authorities to serve PIT- CUN (originally in Docket OST-00-7338) and CLT/PHL-CUN (originally in Docket 97-2128) and consolidated them into this Docket. By NOAT, May 20, 2004, the Department granted US Airways authority to serve Ft. Lauderdale-Cancun in this Docket. US Airways currently operates service in each of these markets using Airbus and Boeing aircraft in its fleet.

Supplement to Application to Amend an Exemption
US Airways, Inc. hereby submits a supplement to its long-deferred application to amend its current exemption in this docket so that it may operate scheduled foreign air transportation of persons, property, and mail between Baltimore, Maryland, and Cancun, Mexico, with flights beginning on or around mid-February 2006. US Airways also seeks integration authority to combine this exemption authority with US Airways' other authorities,' and further requests a designation for this service.
US Airways intends to inaugurate nonstop service from Baltimore, MD (BWI) to Cancun, Mexico. This new service will complement existing US Airways service to Mexico (Cancun, Cozumel and Mexico City). In so doing, US Airways will bring the benefits of additional competition, new nonstop service, and additional on-line connecting options for consumers. It will also enable US Airways (i) to expand its presence in the region and (ii) to offer consumers and shippers expanded, competitive service options.
US Airways plans to operate its services on a seasonal basis commencing around mid-February 2006. The initial service plans are for Saturday-only service. For these services, US Airways plans to utilize B737-300 aircraft, currently in its fleet, with 126-seats configured as 12F and 114Y.

Answer of the State of Maryland in Support of Application for an Exemption
The State of Maryland, in its capacity as owner-operator of Baltimore/Washington International Thurgood Marshall Airport, submits this Answer to the Application of US Airways, Inc. for an exemption authorizing it to engage in non-stop scheduled foreign air transportation of persons, property and mail between BWI and Cancun, Mexico, and for a designation under the U.S.-Mexico Air Transport Agreement to provide such service.
Maryland submits that US Airways' application is consistent with the public interest and should be granted for the following reasons. First, the new service would benefit passengers and shippers, the Baltimore community and the entire Washington/Baltimore region. The service would also benefit passengers connecting through BWI on US Airways and other flights to or from other U.S. cities. Second, the service would create additional opportunities for expanded tourism, international trade, and business for Maryland.

Motion for a Temporary Dormancy Waiver
US Airways, Inc. hereby moves for a temporary dormancy waiver with respect to its services between (i) Ft. Lauderdale, Florida, and Cancun, Mexico, (ii) Pittsburgh, Pennsylvania, and Cancun, Mexico, and (iii) Philadelphia, Pennsylvania, and Cozumel, Mexico. US Airways further seeks a waiver from the normal start-up conditions attached to new Mexico authorities with respect to its pending application for exemption authority to operate service between Baltimore, Maryland, and Cancun, Mexico.
Due to the devastation caused by Hurricane Wilma in Cancun/Cozumel, US Airways has been forced to revise its service plans for the above-described routes. US Airways currently anticipates that it will resume FLL-CUN service on or about January 31, 2006, and that it will resume PIT-CUN service on or about March 1, 2006. PHL-CZM service is projected to resume on or about December 1, 2006. Accordingly, US Airways requests a temporary waiver so that the 90-day dormancy periods for FLL-CUN, PIT-CUN, and PHL-CZM will commence on January 31, 2006, March 1, 2006, and December 1, 2006, respectively.
US Airways does not currently hold BWI-CUN authority but expects, under the terms of the recently negotiated amendments to the Air Transport Services Agreement between the Government of the United States of America and the Government of the United Mexican States, to receive such authority and the corresponding designation soon after the signing of the accord. Unfortunately, in light of the hurricane devastation, US Airways does not believe it will be able to start such a new service before December 1, 2006. Accordingly, US Airways requests a waiver from the normal start-up conditions imposed on new Mexico services until December 1, 2006.

USA 3000:
Scheduled foreign air transportation of persons, property, and mail between Washington, D.C. and Cancun, Mexico. USA 3000 states that it will initiate scheduled service in the subject market within 30 days of an award of the requested authority.
On April 21, 2005, USA 3000 requested an amendment to its existing exemption authority to serve the Baltimore-Cancun route, to the extent necessary to authorize service to Cancun from Washington, D.C. (Dulles). On September 21, 2005, the United States and Mexico reached an ad referendum agreement on certain amendments to the U.S.-Mexico aviation agreement, including as concerns service between Baltimore and Washington, D.C., on the one hand, and Cancun, on the other. By Notice dated October 5, 2005, the Department invited U.S. carriers to supplement already-filed applications and/or to file new exemption/certificate applications in light of the amendments. On October 17, 2005, in response to the Department’s Notice, USA 3000 filed a supplement to its application confirming its intention to serve the Washington (Dulles)-Cancun market.
US Airways:
Scheduled foreign air transportation of persons, property, and mail between Baltimore, Maryland, and Cancun, Mexico. US Airways proposes to operate this service on a seasonal basis, commencing operations before December 1, 2006.
On March 30, 2004, US Airway requested an amendment to its existing exemption authority for U.S.-Mexico service so that it might serve the Baltimore/Washington, D.C.-Cancun market. By Notice of Action Taken dated May 20, 2004, we deferred action on the carrier’s request as there were no designation opportunities available. United Air Lines, Inc. and USA 3000 were the incumbents in the market. The Department noted that Washington/Baltimore was considered a single U.S. gateway under the bilateral agreement. On October 17, 2005, in response to the Department’s October 5 Notice, US Airways filed a supplement to its application requesting exemption authority to serve only the Baltimore-Cancun market.

Motion for a Temporary Dormancy Waiver - Clarification
On December 2, 2005, US Airways, Inc. filed a motion for a temporary dormancy waiver in the above-referenced dockets regarding its Ft. Lauderdale-Cancun, Pittsburgh-Cancun, and Philadelphia-Cozumel authorities. US Airways herein seeks to clarify its dormancy waiver request.
US Airways requests that the dormancy period not commence as to FLL-CUN and PIT-CUN until January 31, 2006, and March 1, 2006, respectively. With regard to PHL-CZM, US Airways is seeking a condition requiring it to start such services no later than December 1, 2006. We believe this request related to the PHL-CZM authority is consistent with the dormancy waiver recently granted to American Airlines. See NOAT, December 28, 2005 (Dockets OST-2001-9027, OST-2002-13389) (granting American dormancy waiver on STL-CUN and BOS-CUN authorities but "requir[ing] American to institute services no later than December 1, 2006").

Motion for a Limited Waiver of the Dormancy Period
US Airways hereby moves for a limited waiver of the dormancy period with respect to its service between Pittsburgh, Pennsylvania, and Cancun, Mexico, whereby it will resume service on this route no later than June 15, 2006.
On January 19, 2006, the Department granted US Airways’ request to commence the dormancy periods of its FLL-CUN and PIT-CUN routes on January 31, 2006, and March 1, 2006, respectively. By the Department granting this request, the dormancy period for PIT-CUN will end on May 30, 2006.
The schedule change with which US Airways will resume its Saturday only PIT-CUN service becomes effective on Sunday, June 4, 2006. Because PIT-CUN service will be Saturday only, however, US Airways’ first flight will not take place until June 10, 2006. As a result, US Airways moves for a brief extension or waiver of the dormancy period with respect to its PIT-CUN service that will allow it to resume service on this route no later than June 15, 2006.

On March 21, 2005, the Department of Transportation renewed US Airways, Inc.'s existing exemption authority to provide scheduled foreign air transportation between Philadelphia, Pennsylvania, and Cozumel, Mexico, for a period of two years (See Notice of Action Taken, March 21, 2005, Docket OST-2001-9768). Similarly, on October 16, 2006, the Department renewed US Airways' existing exemption authority to provide scheduled foreign air transportation between Ft. Lauderdale, Florida and Cancun, Mexico, for a period of two years (See Notice of Action Taken, October 16, 2006, Docket OST-2002-13855).
In accordance with the Conditions set forth in each Notice of Action Taken described above, US Airways hereby advises the Department that it will no longer operate either Philadelphia-Cozumel or Ft. Lauderdale-Cancun service, effective immediately. Accordingly. US Airways respectfully provides notice of dormancy with respect to these routes.
Philadelphia-Cozumel exemption authority was originally contained within Docket OST-2003-15253. Concurrent with its renewal of US Airways' Philadelphia-Cozumel exemption authority, the Department consolidated this exemption authority with US Airways' exemption to provide scheduled air service between Charlotte, North Carolina, and Cozumel. Mexico, in Docket OST-2001-9768.
