US Airways has been developing its Caribbean route network in recent years. US Airways now plans to expand further its Caribbean services through an inter-island codeshare with WINAIR. The proposed services will provide the substantial benefits of additional competition and on-line connecting options for numerous communities in the eastern United States to passengers traveling between the United States and the Caribbean.
In order to initiate these inter-island codesharing services and provide the resulting benefits to consumers and shippers, the Joint Applicants request the following authorities: (a) a statement of authorization under Part 212 and an exemption from 49 U.S.C. § 41301 permitting WINAIR to transport persons, property, and mail under US Airways' designator code ("US") on WINAIR's scheduled flights from St. Maarten, on the one hand, to Anguilla, Saba, St. Eustatius, St. Barthelemy, St. Kitts & Nevis, and Antigua, on the other hand; and (b) an exemption from 49 U.S.C. § 41101 permitting US Airways to engage in scheduled foreign transportation of persons, property and mail from the United States to Anguilla, Saba, St. Eustatius, and, to the extent necessary, St. Barthelemy.
US Airways and WINAIR have signed a codesharing agreement, whereby US Airways will place its two-letter "US" designator code on flights operated by WINAIR - effective December 2002 - between St. Maarten, on the one hand, and Anguilla, Saba, St. Eustatius, St. Barthelemy, St. Kitts & Nevis, and Antigua, on the other hand. A copy of the codesharing agreement is attached as Exhibit D. Consistent with well-established practice with other agreements, confidential and proprietary information has been redacted from the document.

Scheduled foreign air transportation of persons, property, and mail between points in the United States, on the one hand, and Anguilla, Saba, St. Eustatius, and St. Barthelemy, on the other. US Airways intends to operate this service pursuant to a code-share arrangement with Windward Islands Airways International, N.V. In connection with US Airways' proposed code share to these points, the joint applicants state that US Airways already holds authority for U.S.-St. Kitts and Nevis, U.S.-Antigua, and U.S.-France services. (See Notices of Action Taken dated January 16, 2002, July 5, 2001, and Order 2002-5-25, respectively.)

Application for Renewal of an Exemption
By Notice of Action Taken, December 16,2002, the Department granted US Airways authority in this Docket to engage in scheduled foreign air transportation between points in the United States and Anguilla, Saba, St. Eustatius, and St. Barthelemy pursuant to its codesharing arrangement with WINAIR.

Notice of Cessation of Codesharing
On July 29, 2005, the Department of Transportation renewed US Airways, Inc.'s existing exemption authority to provide scheduled foreign air transportation from the United States to Montserrat, pursuant to a codeshare agreement with Winward Islands Airways International, for a period of two years. (See Notice of Action Taken, July 29, 2005, Docket OST-2005-21354). Similarly, on October 5, 2004, US Airways timely filed its application for renewal of exemption authority to provide scheduled foreign air transportation between, "points in the United States, on the one hand, and Anguilla...on the other, pursuant to its codesharing agreement with [WinAir]." (Application of US Airways, Inc. for Renewal of an Exemption, Docket OST-2002-13705).
In accordance with the Conditions set forth in each Notice of Action Taken described above, US Airways hereby advises the Department that it is no longer placing its "US" designator code on flights operated by WinAir in the following markets:
