Emirates requests a foreign air carrier permit authorizing it to engage in scheduled foreign air transportation of persons, property and mail, including all-cargo service, from points behind the U.A.E., via the U.A.E. and intermediate points, to a point or points in the United States and beyond. Emirates also requests authority to engage in all-cargo service between the United States and any point or points in third countries and to operate charters pursuant to 14 C.F.R. Part 212. In June 2003, Emirates plans to introduce daily nonstop service between Dubai and New York (JFK) using A340-500 equipment. Emirates intends to add daily nonstop service between Dubai and Chicago in October 2003.

Emirates has today filed an application with the Department of Transportation requesting the granting to Emirates of a foreign air carrier permit to engage in scheduled foreign air transportation of persons, property and mail, including all-cargo service, from points behind the U.A.E., via the U.A.E. and intermediate points, to a point or points in the United States and beyond; to engage in all-cargo service between the United States and any point or points in third countries; and to operate charters pursuant to 14 C.F.R. Part 212. Answers in support of or in opposition to the application are due within 21 days from the date of this Notice.

The Port Authority of New York and New Jersey supports the application of Emirates for a foreign carrier permit. The proposal put forth by the carrier will be the only one offering daily non-stop service from Dubai, in the United Arab Emirates (UAE) to the U.S in general and the New York/New Jersey region. We believe there is a potential for increased business and personal travel between our region and the UAE that this service will help fulfill.

Correspondence of Emirates

Although Emirates and Continental intend to implement their code share as soon as possible following the Department's grant of the necessary authorizations, Emirates does not expect to commence operating to and from points in the United States using its own aircraft before April 2004. Emirates is in the final stages of securing its U.S. operating authority from the FAA and is confident that it will have that authority well in advance of its projected start-up date. In the meantime, to expedite implementation of the code share and minimize the Department's administrative burden, Emirates requests that the Department promptly approve the above applications' subject to an interim condition that Emirates may exercise the authority granted only as part of an authorized code-share or wet-lease arrangement with another authorized carrier or carriers. 3 Emirates subsequently will inform the Department of its specific timetable for commencing flights to and from U.S. points using its own aircraft and the Department then will have an opportunity to complete any additional review procedures it may deem necessary as a predicate to amending Emirates' authority to eliminate the interim condition.

Re: Emirates

On July 1, 2003, the Department issued a Notice of Action Taken ("NOAT") in Docket OST‑00‑7490 granting Emirates an exemption to serve the United States consistent with the scope of authority available under the U.S.‑United Arab Emirates open skies bilateral agreement. At Emirates' request,1 however, the Department included in the NOAT a temporary condition, pending the FAA's issuance of Operations Specifications to Emirates, stating that "Emirates may exercise the authority granted in this notice only as part of a Department‑authorized code‑share or wet‑lease arrangement with a duly authorized and properly supervised carrier or carriers." This same condition was included in statements of authorization issued by the Department authorizing Emirates to engage in code sharing with Delta Air Lines, Inc and Continental Airlines, Inc. See Department Action dated July 1, 2003 (Docket OST‑00‑7495); NOAT dated Oct. 14, 2003 (Docket OST‑03‑15805).

As the Department is aware, the FAA recently issued Operations Specifications to Emirates following receipt from the Transportation Security Administration of confirmation that Emirates has satisfied TSA's requirements and TSA's recommendation that the FAA issue Emirates' Operations Specifications. Emirates therefore respectfully requests that the Department amend the authorizations issued to Emirates in Dockets OST-00-7490, 00-7495, and 03-15805 to remove the above-referenced condition, thereby enabling Emirates to commence holding out service to and from the United States using its own aircraft. Emirates plans to commence such service in June 2004.

Order Issuing Foreign Air Carrier Permit

We find that Emirates is operationally and financially fit to conduct the operations at issue here. Emirates commenced operation in 1985 and currently serves 56 destinations in more than 40 countries, with a fleet of 40 aircraft, including both Boeing and Airbus equipment. Emirates received initial Department authority in 1993 to engage in codeshare services with United Air Lines (United) for the carriage of United's passengers on the London-Dubai segment of United's U.S.-Dubai services. We subsequently granted Emirates initial Department authority to serve the United States on July 1, 2003, and January 23, 2004 (see Dockets OST-2000-7490 and 2000-7495). Emirates' services to the United States will be operated with Emirates-registered A-340-500 aircraft. Emirates' aircraft are maintained in-house and under contract with Rolls-Royce PLC, Air France and Garrett.
