Compania Mexicana de Aviacion S.A. de C.V. and United Air Lines, Inc. hereby apply for the following authorities to allow them to expand their transborder code-share services between the United States and Mexico: (i) a statement of authorization under 14 C.F.R. 212 permitting Mexicana to display United's two-letter designator code on scheduled nonstop flights operated by Mexicana between Sacramento, CA and Guadalajara, Mexico, and between Denver, CO and Mexico City; and (ii) an exemption under 49 U.S.C. §40109 permitting United to hold out scheduled service between Sacramento and Guadalajara and between Denver and Mexico City, under a code share with Mexicana. Mexicana and United request that Mexicana's statement of authorization and United's exemption be granted for a two-year period.

The Sacramento-Guadalajara flight continues on to Mexico City and United will also display its code on that intra-Mexico segment on a blind-sector basis. United and Mexicana have blanket authorizations to code share between points within Mexico under Notice of Action Taken, dated April 26, 2001, in Docket OST-96-1988, et al., and Order 99-6-6. Notice has already been given of code sharing on services between Guadalajara and Mexico City. See Notice dated July 19, 1999, in Docket OST-97-3237.

Exemption for United for two years under 49 U.S.C. 40109 to provide the following service: Scheduled foreign air transportation of persons, property, and mail between (1) Sacramento, California, and Guadalajara, Mexico; and (2) Denver, Colorado, and Mexico City, Mexico. United intends to operate this service under a code-share arrangement with Mexicana on flights operated by Mexicana.

Statement of Authorization for Mexicana under Part 2 12 of the Department's Regulations to: Display United's "UA" designator code on flights operated by Mexicana between Sacramento and Guadalajara, and between Denver and Mexico City.

Re: Joint Notification of Termination of Codeshare and Regulatory Cooperation Agreement

In accordance with the terms of the Department of Transportation's approvals of the statements of authorization in the above‑captioned dockets, Compania Mexicana de Aviacion, S.A. de C.V. and United Air Lines, Inc. hereby notify the Department of the expiration of their Codeshare and Regulatory Cooperation Agreement effective November 15, 2003. As a result of the Agreement's expiration, all codeshare services operated by Mexicana and United will be discontinued effective March 31, 2004, and the related statements of authorization cease to be effective after that date. This notice applies only to the statements of authorization issued in the above referenced dockets and not to any exemptions granted to United or Mexicana in those dockets or any other docket.

Application for Renewal of an Exemption

United intends to continue to operate seasonal nonstop service with its own aircraft between Denver and Mexico City. Renewal of this exemption authority, as requested herein, is clearly in the public interest, and United requests renewal of its exemption based on the original findings that the proposed services are fully consistent with the bilateral air transportation agreement between the U.S. and Mexico. On August 15, 2002, the Department approved United's request to convert its code-share only designation for Denver-Mexico City to a direct service designation so United could commence seasonal nonstop service between Denver and Mexico City with its own aircraft. (See attached copy of Department Action dated August 15, 2002; See also, Department Action on Application in Docket OST-02-13092, dated August 15, 2002.) United's exemption authority to serve Denver-Mexico City is currently set to expire on June 20, 2004.

By this same NOAT, United was granted exemption authority to engage in scheduled foreign air transportation of persons, property, and mail between Sacramento, California and Guadalajara, Mexico, under a code-share arrangement with Mexicana, and Mexicana was granted a statement of authorization to display United's designator code on flights operated by Mexicana between Sacramento and Guadalajara and between Denver and Mexico City. By letter dated November 14, 2003, a copy of which was filed in the above-referenced docket, United and Mexicana notified the Department of the termination of all of their code-share services with each other effective March 31, 2004. As United's exemption authority for Sacramento-Guadalajara is for code-share service only, United is not seeking renewal of its exemption authority to serve that city-pair.

Scheduled foreign air transportation of persons, property, and mail between: (1) San Francisco, California, and San Jose del Cabo, Mexico; (2) San Francisco, California, and Puerto Vallarta, Mexico; (3) San Francisco, California, and Cancun, Mexico; and (4) Los Angeles, California, and Ixtapa/Zihuatanejo, Mexico. United states that it serves these markets on a seasonal basis.

The above action was effective when taken: October 16, 2006, through October 16, 2008, or until 90 days after the Department’s final action on the carrier’s corresponding certification application, in Docket OST-1999-5846, whichever occurs earlier.

By Notice of Action Taken, dated October 16, 2006, in Docket OST-2002-12502, the Department renewed United’s exemption authority to operate scheduled combination services on a seasonal basis in the Denver, Colorado and Mexico City, Mexico market.

By Notice of Action Taken, dated October 16, 2006, in Docket OST-2004-17676, the Department renewed United’s exemption authority to operate scheduled combination services on a seasonal basis between (1) Denver, Colorado and Ixtapa/Zihuatanejo, Mexico; and (2) Denver, Colorado and San Jose del Cabo, Mexico.

By Notice of Action Taken, dated October 16, 2006, in Docket OST-2004-17685, the Department renewed United’s exemption authority to operate scheduled combination services on a seasonal basis between (1) San Francisco, California and San Jose del Cabo, Mexico; (2) San Francisco, California and Puerto Vallarta, Mexico; (3) San Francisco, California and Cancun, Mexico; and (4) Los Angeles, California and Ixtapa/Zihuatanejo, Mexico.

United requests that the Department renew its aforesaid exemption authorities for a minimum period of two years, subject to the usual conditions, or until its certificate for Route 566 is amended to include the route segments specified above.

Re: Clarification Letter

Through an inadvertent omission, United did not electronically distribute a copy of its renewal application related to exemption authorities granted in the above-referenced proceedings. The application was filed with the Department yesterday. United is distributing a copy of its renewal application now and advises that it would have no objection to extending the answer date to August 28, 2008.
