AeroSvit is a closed-type joint stock company first founded and registered as a legal entity on March 25, 1994 (Registration Certificate Number 4942) under the applicable laws of Ukraine. AeroSvit was originally registered under the name of "AeroSweet," which was subsequently changed into its current name of "AeroSvit Airlines" in 1997. AeroSvit is owned and effectively controlled by Ukrainian nationals. See Exhibits AV-3 & AV-4. AeroSvit holds an Operator's Certificate from the Ukrainian Ministry of Transportation authorizing AeroSvit to operate domestic and international commercial air services, such certificate being regularly renewed upon application by AeroSvit to the Ukrainian government.

AeroSvit requests a foreign air carrier permit authorizing it to engage in scheduled combination air transportation operations (1) between any point or points in Ukraine and New York, United States. AeroSvit is also requesting a foreign air carrier permit authorizing it to engage in non-scheduled combination air transportation operations (1) between any point or points in Ukraine and in the United States; and (2) between any point or points in the United States and any point or points in a third country or countries subject to pertinent national, bilateral and international rules and regulations. As a result of AeroSvit's desire to begin operating scheduled services and advertise its services in its own right as soon as possible, AeroSvit is contemporaneously filing an Application for an Exemption that would authorize the services that are the subject of this application.

AeroSvit will utilize Boeing B767 aircraft, or such other aircraft as it may have or acquire to conduct the proposed operations. See Exhibit AV-10. The aircraft AeroSvit intends to operate are registered in Ukraine and are maintained by qualified engineering personnel holding the appropriate certificates for technical maintenance. Routine maintenance for AeroSvit's existing B 737 aircraft as well as its proposed long-range aircraft is and will be performed by the JAR 145 licensed Maintenance Organization at Aeroplex of Central Europe Ltd.  The carrier currently serves five major domestic business and leisure destinations in Ukraine as well as 32 international destinations in 17 counties including Israel (Tel Aviv), Turkey (Istanbul, Antalya), Malta, Bulgaria (Sofia, Burgas, Vama), Greece (Athens, Heaklion), Egypt (Hurgada), Cyprus (Larnaca, Pathos), Poland (Warsaw), Russia (Moscow), Turkmenistan (Ashkabat), Hungary (Budapest), Czech Republic (Prague), Sweden (Stockholm), Yugoslavia (Belgrade), Latvia (Riga), Estonia (Tallinn), Tunis (Monastir). There are currently plans to expand services to Delhi and Bangkok in the winter of 2002/03.

Hereby applies for an exemption from 49 U.S.C. § 41302 and such other statutes and the Department's Regulations as may be required, to engage in scheduled and charter combination service between Ukraine and the United States. AeroSvit intends to start New York - Kiev scheduled service not later than the spring of 2003 utilizing Boeing 767 equipment.

Amendment No. 1 to Application for a Foreign Air Carrier Permit

AeroSvit hereby seeks to amend its application to update certain evidentiary materials required by 14 C.F.R. § 211.20 contained in Exhibits AV-1 through AV-18 that were submitted as part of its initial Application for a Foreign Air Carrier Permit in the above-referenced docket. Specifically, AeroSvit would like to update information contained in Exhibit AV-4, Ownership Information, to reflect a change in the list of its shareholders, as shown in amended Exhibit AV-4 attached hereto. The referenced changes, however, do not in any way impact or change the nationality of AeroSvit as a Ukrainian flag carrier, or its proven fitness and ability to operate the services that are the subject of its Application for a Foreign Air Carrier Permit.

Additionally, AeroSvit requests that Amended Exhibit AV-4 be substituted for the initially submitted Exhibit AV-4 in docket OST-2002-12355.
