On May l, 2002, AWAC will initiate double-daily service between Denver and Edmonton, Alberta - Canada using CRJ 50-seat equipment. As a United Express carrier, AWAC will display the "UA" designator code of United Air Lines, Inc. on its U.S.-Canada services. Recently, the Department also granted AWAC a statement of authorization to display Air Canada's "AC" designator code on these flights. Application for Renewal of Exemption

AWAC is authorized by blanket exemption to operate services between the U.S. and Canada using small equipment such as the CRJ, which is configured with 50 seats. 14 CFR §206.5. Of the 87 aircraft in AWAC's fleet, 17 of which are BAe‑146 series four engine jet aircraft configured with between 86 and 100 seats. By this application, AWAC seeks renewal of its exemption authorizing it to operate service between the U.S. and Canada with large aircraft, which will provide AWAC with the flexibility to use its BAe aircraft for U.S.‑Canada services should the traffic demand and AWAC' s operational needs warrant.

As a United Express carrier, AWAC will display the "UA" designator code of United Air Lines, Inc. on its U.S.-Canada services. The Department has also granted AWAC a statement of authorization to display Air Canada's "AC" designator code on these flights. See Department Action on Application in Docket OST-2002-12050

In its original exemption application, AWAC noted it would begin service between Denver, CO and Edmonton, Alberta-Canada using CRJ 50-seat equipment. Since DOT's approval of its exemption authority, AWAC has added service between Chicago, Illinois and Winnipeg, Manitoba (YWB)-Canada. It subsequently notified the Department on May 6, 2003 of its intent to carry the "AC" code on the ORD-YWB flight.

Statement of Authorization approving Air Wisconsin/Air Canada code-share operations dated April 16, 2002 (Docket OST-2002-12050).

Due to the emergency nature of the application we granted this authority for a short term (i.e., through May 31, 2006), and deferred action on the remainder of the request pending the receipt of answers.

We are dismissing the applicant's request for renewal of exemption authority as the authority expired on May 11, 2006 and the renewal application was not timely filed under the terms of 14 CFR 377.10(c). We deem the authority granted in the Department's April 16, 2002, statement of authorization also to encompass the operations described in the instant application.

Renewal of scheduled foreign air transportation of property and mail between any point or points in the United States and any point or points in Canada with large aircraft.

By Notice of Action Taken, dated May 12, 2006, we granted AWAC short-term exemption authority (i.e., through May 31, 2006) and deferred action on the remainder of the request pending the receipt of answers. We also dismissed the applicant’s request for renewal of exemption authority as the authority expired on May 11, 2006, and the renewal application was not timely filed under the terms of 14 CFR 377.10(c).  This Notice of Action Taken addresses the still-pending portion of the applicant’s request.

Statement of Authorization approving Air Wisconsin/Air Canada code-share operations dated April 16, 2002 (Docket OST-2002-12050).

We deem the authority granted in the Department’s April 16, 2002, statement of authorization also to encompass the operations described in the instant application.

Application for Renewal of Exemption Authority

Air Wisconsin Airlines Corporation hereby applies for renewal of its exemption from 49 U.S.C. §41101 authorizing AWAC to engage in scheduled foreign air transportation of passengers, property and mail between any point or points in the United States and any point or points in Canada with large aircraft. The Department of Transportation, by Notice of Action Taken issued May 18, 2006 renewed AWAC's exemption authority for a period of two years.
