Application for an Exemption Exemption - United States-Algiers, Algeria

Upon approval of this application, Delta plans to introduce new codeshare service to Algiers in conjunction with its SkyTeam alliance and codeshare partner, Alitalia. Delta further requests route integration authority to permit Delta to combine service on this route with all other Delta services authorized by existing certificates and exemptions granted by the Department, to the extent permitted by applicable international agreements.  There is no bilateral air services agreement between the United States and Algeria. Thus, Delta’s authority to serve Algiers is governed by principles of comity and reciprocity.

Delta initially plans to use this exemption to serve Algiers on flights operated by Alitalia’s wet lease subsidiaries via Rome; however, consistent with established DOT policy and precedent, Delta requests exemption authority to serve Algiers via alternate intermediate gateways and with other approved codeshare partners upon notice to the Department.

Re: Letter Dismissing Subsumed Docket

The above-captioned application was filed to permit Delta to serve Algiers, Algeria on a codeshare basis with Alitalia. The requested authority is now subsumed by the blanket codeshare exemption granted By Notice of Action Taken in docket OST-05-20145 (March 1, 2005). Accordingly, the Department may dismiss the above-captioned exemption application in docket OST-02-12161 as moot.
