Notice of Action Taken Germany-US Executive Charters

Exemption from 49 USC section 41301 to permit the applicant to conduct, using small equipment (see below), charter operations, carrying persons, property and mail, as follows: between any point or points in Germany and any point or points in the United States; and between any point or points in the United States and any point or points in a third country or countries, provided that, except with respect to cargo charters, such service constitutes part of a continuous operation, with or without change of aircraft, that includes service to Germany for the purpose of carrying local traffic between Germany and the United States; and other charter operations pursuant to 14 CFR Part 212.

Application for Renewal of an Exemption

JetConnection's exemption authority was initially granted for a two-year term by Notice of Action Taken dated February 25, 2003. JetConnection requests that its exemption be renewed for a period of two additional years, or until 90 days after the Department's final determination on JetConnection's Application for a Foreign Air Carrier Permit pending in Docket OST-2002-11905, whichever occurs earlier.

Application for Renewal of an Exemption

JetConnection Businessflight AG hereby applies for renewal of an exemption from 49 U.S.C. § 41301 to permit JetConnection to continue to operate the following flights using small aircraft: (1) charter operations, carrying persons, properly and mail, between any point or points in Germany and any point or points in the United States; and between any point or points in the United States and any point or points in a third country or countries, provided that, except with respect to cargo charters, such service constitutes part of a continuous operation, with or without a change of aircraft, that includes service to Germany for the purpose of carrying local traffic between Germany and the United States; and (2) other charter operations pursuant to 14 C.F.R. Part 212.

JetConnection's exemption authority was initially granted for a period of two-years by Notice of Action Taken dated February 25, 2003, and last renewed for an additional two years by Notice of Action Taken dated March 9, 2005 (Docket OST-2002-11906). JetConnection requests that its exemption be renewed for an additional period of two years, or until the Department's final determination on JetConnection's Application for a Foreign Air Carrier Permit pending in Docket OST-2002-11905, as supplemented, whichever occurs earlier.

JetConnection noted in its permit application supplement dated April 2, 2007 that it intended to pursue EU-U.S. open skies authority through procedures established by the Department. Consistent with the EU Carriers Notice, JetConnection hereby confirms that it is applying for expanded authority (in addition to the Germany-U.S. open skies charter authority described in its permit and exemption renewal applications), including amended exemption authority, to conduct the following charter services, effective as of March 30, 2008:

Order Granting Exemptions and To Show Cause

We grant the request of JetConnection Businessflight AG for an exemption under 49 U.S.C. §40109 to permit it (1) effective on the issue date of this order, to accept payment and issue tickets, and enter into charter contracts, and (2) effective March 30, 2008, to commence flight operations: a) charter foreign air transportation of persons, property and mail between any point or points behind EU Member States, via the Member States and intermediate points to any point or points in the United States and beyond; b) charter foreign air transportation of persons, property and mail between any point or points in the United States and any point or points in any member of the European Common Aviation Area; and c) other charters pursuant to the prior approval requirements set forth in 14 CFR Part 212 of the Department’s regulations.

To the extent not acted upon above, we dismiss all requests for relief in Docket DOT-OST-2002-11906.

Final Order

By Order 2007-12-9, issued December 14, 2007, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award an amended foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto. We gave interested persons 21 days to file objections to the Order. We said that if no objections were filed, all further procedural steps would be deemed waived, and the Department would enter an order (subject to Presidential review under 49 U.S.C. §41307) which would make final the findings and conclusions of the Order.

No objections were received within the time period provided.
